Health Insurance Commission Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Health Insurance Commission Act 1973.

1. Amendment

1.1 The Health Insurance Commission Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

 

2. New regulation 3g

2.1 After regulation 3f, insert:

Additional functions of the Commission: Hib vaccinations

“3g. (1) For the purposes of subsection 8e (1) of the Act, the following functions are prescribed:

(a) on behalf of the Commonwealth, to assess Hib vaccination claims; and

(b) on behalf of the Commonwealth, to make payments in respect of valid Hib vaccination claims.

“(2) In this regulation:

Hib vaccination claimmeans a claim by an individual for the cost of purchase, during the period from 1 April 1993 to 30 June 1995 (both dates inclusive), of vaccine against Haemophilus influenzae type b for administration to infants born on or after 1 February 1993.”.

4. Regulation 4a (Modification of Part V of the Act)

4.1 Omit “3e and 4:”, substitute “3e, 3g and 4:”.

4.1 Paragraph 4a (a) (inserted paragraph 32a(1) (c)):

Omit “3b and 3c”, substitute “3b, 3c and 3g”.
