Health Insurance Commission Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Health Insurance Commission Act 1973.

1.   Commencement

1.1   Regulation 3 and subregulations 4.4, 4.5 and 4.6 are taken to have commenced on 9 June 1993.

[NOTE: The remainder of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Amendment

2.1   The Health Insurance Commission Regulations are amended as set out in these Regulations.

3.New regulation 2AB

3.1   After regulation 2A, insert:

Definition of recognised class of functions: certain functions prescribed

 “2AB. For the purposes of paragraph (c) of the definition of “recognised class of functions” in subsection 3 (1) of the Act, the class of functions is prescribed that is made up of the following functions:

• (a)

  the processing and payment of claims relating to stoma appliances under regulation 3D;

• (b)

  the provision of pharmaceutical benefits under regulation 3E;

• (c)

  the making of payments to Diabetes Australia under regulation 3J.”.

4.   Regulation 4A (Modification of Part V of the Act)

4.1   Omit “regulations 3, 3A, 3B, 3C, 3D, 3E, 3G, 3H and 4:”, substitute “regulations 3, 3A, 3B, 3C, 3D, 3E, 3G, 3H, 3J, 3K, 3L, 3M, 3N and 4:”.

4.2   Paragraph 4A (a) (inserted paragraph 32A (1) (c) of the Act):

Omit “regulations 3, 3A, 3B, 3C, 3G and 3H”, substitute “regulations 3, 3A, 3B, 3C, 3G, 3H, 3K, 3L, 3M and 3N”.

4.3   Paragraph 4A (b) (inserted subsection 34AA (1) of the Act):

Omit “regulations 3D and 3E”, substitute “regulations 3D, 3E and 3J”.

4.4   Paragraph 4A (c):

Omit the paragraph.

4.5   Paragraph 4A (d):

Omit the paragraph.

4.6   Paragraph 4A (e):

Omit the paragraph.

4.7   Paragraph 4A (f) (inserted subsection 36 (6AA) of the Act):

Omit “regulation 3D or 3E”, substitute “regulation 3D, 3E or 3J”.
