s1 2 s4 Health (Drugs and Poisons) Amendment (No. 3) No. 326, 1999 ˙ Short title 1. This regulation may be cited as the Health (Drugs and Poisons) Amendment Regulation (No. 3) 1999 . ˙ Regulation amended 2. This regulation amends the Health(DrugsandPoisons)Regulation1996 . ˙ Amendment of s 78 (Specified condition drugs—amphetamine, dexamphetamine, methylamphetamine, methylphenidate, phenmetrazine) 3. Section 78(1)(ba), from ‘a child’— omit, insert— ‘brain damage or attention deficit disorder in a child; or’. ˙ Amendment of s 84 (Dealing with prescriptions and certain written instructions) 4.(1) Section 84(3)— omit, insert — ‘ (3) The dispenser must send the prescription or written instruction to the chief executive— (a) for a repeat prescription—within 14 days of dispensing the controlled drug on the last repeat of the prescription; or (b) for another prescription or a written instruction—within 14 days of dispensing or supplying the controlled drug. Maximum penalty—40 penalty units. ‘ (3A) If the dispenser dispenses the controlled drug on a repeat prescription, but not as the last repeat, the dispenser must forward the relevant information for the prescription or written instruction to the chief executive within 14 days after dispensing the controlled drug.

(2) Section 84(5)— omit, insert — ‘ (5) Subsection (1)(b)(ii) applies to a repeat prescription only if the last repeat of the prescription is dispensed.’. (3) Section 84— insert — ‘ (7) In this section— “relevant information” , for a prescription or written instruction, means— (a) the information appearing on the front of the prescription; and (b) the information the dispenser is required to write on the prescription or written instruction at the time of dispensing the controlled drug.’. ˙ Amendment of s 303 (Inspector not required to deliver portion of drug or poison seized) 5. Section 303(4), ‘1999’— omit, insert — ‘2000’. ˙ Amendment of s 303A (General powers after entering places) 6. Section 303A(6), ‘1999’— omit, insert — ‘2000’.
