Health (Drugs and Poisons) Amendment Regulation (No. 1) 2015 [s 1] 1 Short title This regulation may be cited as the Health (Drugs and Poisons) Amendment Regulation (No. 1) 2015 . 2 Regulation amended This regulation amends the Health(DrugsandPoisons)Regulation 1996. 3 Amendment of s 74 (When endorsement is not needed) Section 74(3), from ‘a clinical trial’— omit, insert— an approved clinical trial. 4 Amendment of s 183 (When endorsement is not needed) Section 183(3), from ‘a clinical trial’— omit, insert— an approved clinical trial. 5 Amendment of s 186 (Acitretin, etretinate, isotretinoin and tretinoin) Section 186(2)(a), from ‘a clinical trial’— omit, insert— an approved clinical trial; or 6 Amendment of s 270 (When endorsement is not needed) Section 270(4), from ‘a clinical trial’— omit, insert— an approved clinical trial. Health (Drugs and Poisons) Amendment Regulation (No. 1) 2015 [s 7] 7 Amendment of s 270A (Approval must not be granted for therapeutic use of S9 poisons) Section 270A, ‘The’— omit, insert Subject to section 270B, the 8 Insertion of new s 270B After section 270A— insert— 270B Approval for cannabis The chief executive may grant an approval to a person to administer, dispense, manufacture, obtain, possess, prescribe, supply or use an S9 poison if— (a) the S9 poison is cannabis; and (b) the approval is for or connected with— (i) an approved clinical trial; or (ii) an approval, for the supply of cannabis for use in the treatment of a person, given under the Therapeutic Goods Act 1989 (Cwlth), section 19(1). 9 Amendment of s 292 (Advertising of poisons) Section 292(5)— omit, insert (5) Subsection (4) does not apply to— (a) a person who refers to cannabis in an advertisement in connection with an approved clinical trial; or (b) a person who refers to Cannabis sativa in an advertisement in connection with an activity 2015 SL No. 176 Page 3
Health (Drugs and Poisons) Amendment Regulation (No. 1) 2015 [s 10] authorised under the DrugsMisuseAct1986 , section 47 or 48(1). 10 Amendment of Appendix 9 (Dictionary) Appendix 9— insert— approved clinical trial means a clinical trial approved by— (a) the Therapeutic Goods Administration; or (b) a human research ethics committee registered by the Australian Health Ethics Committee established under the National Health and Medical Research Council Act 1992 (Cwlth).
