s1 3 s4 Health (Drugs and Poisons) Amendment Regulation No. 333, 2007 (No. 1) 2007 1 Short title This regulation may be cited as the Health (Drugs and Poisons) Amendment Regulation (No. 1) 2007 . 2 Regulation amended This regulation amends the Health(DrugsandPoisons)Regulation 1996 . 3 Amendment of s 66 (Queensland Ambulance Service) Section 66— insert— ‘(4) To the extent necessary to perform ambulance duties for the Queensland Ambulance Service, an isolated practice area paramedic at an isolated practice area (paramedics) is authorised to— (a) obtain a controlled drug; or (b) possess a controlled drug at a place in the isolated practice area (paramedics); or (c) administer or supply a controlled drug to a person— (i) on the oral or written instruction of a doctor or nurse practitioner; or (ii) under a drug therapy protocol.’. 4 Amendment of s 67 (Registered nurses) Section 67(4)(c)(vi)— omit, insert— ‘(vi) give an isolated practice area paramedic an oral or written instruction to administer or supply a controlled drug; or (vii) prescribe a controlled drug.’.
s5 4 s7 Health (Drugs and Poisons) Amendment Regulation No. 333, 2007 (No. 1) 2007 5 Amendment of s 97 (Oral instruction must be put in writing) (1) Section 97(2), ‘worker, registered’— omit, insert— ‘worker, isolated practice area paramedic, registered’. (2) Section 97(2), ‘worker, nurse’— omit, insert— ‘worker, paramedic, registered nurse’. 6 Amendment of s 113 (Record keeping for nursing practice in isolated practice area) (1) Section 113, heading, from ‘nursing’— omit, insert— ‘ certain nursing practices and Queensland Ambulance Service stations ’. (2) Section 113(1)— omit, insert— ‘(1) This section applies if— (a) 2 or more rural and isolated practice endorsed nurses operate a practice in an isolated practice area; or (b) 2 or more isolated practice area paramedics operate a practice in an isolated practice area (paramedics).’. 7 Amendment of s 174 (Queensland Ambulance Service) Section 174— insert— ‘(2A) To the extent necessary to perform ambulance duties for the Queensland Ambulance Service, an isolated practice area paramedic at an isolated practice area (paramedics) is authorised to— (a) obtain a restricted drug; or
s 8 5 s 11 Health (Drugs and Poisons) Amendment Regulation No. 333, 2007 (No. 1) 2007 (b) possess a restricted drug at a place in the isolated practice area (paramedics); or (c) administer or supply a restricted drug to a person— (i) on the oral or written instruction of a doctor or nurse practitioner; or (ii) under a drug therapy protocol.’. 8 Amendment of s 175 (Registered nurses) Section 175(5)(c)(vi)— omit, insert— ‘(vi) give an isolated practice area paramedic an oral or written instruction to administer or supply a restricted drug; or (vii) prescribe a restricted drug.’. 9 Amendment of s 207 (Records of restricted drugs supplied to be kept) Section 207— insert— ‘(1B) An isolated practice area paramedic must keep records, as required by this section, of all restricted drugs supplied by the paramedic under section 174(2A). Maximum penalty—40 penalty units.’. 10 Amendment s 235 (Wholesale and retail sales by manufacturers and wholesalers) Section 235(2)(d), ‘section 252C’— omit, insert— ‘section 256B’. 11 Amendment of s 248A (Dental therapists) Section 248A(3)—
s 12 6 s 14 Health (Drugs and Poisons) Amendment Regulation No. 333, 2007 (No. 1) 2007 insert— ‘(c) ferric sulphate.’. 12 Amendment of s 262 (Queensland Ambulance Service) Section 262— insert— ‘(2) To the extent necessary for performing ambulance duties for the Queensland Ambulance Service, an isolated practice area paramedic at an isolated practice area (paramedics) is authorised to— (a) obtain an S2 or S3 poison; or (b) possess an S2 or S3 poison at a place in the isolated practice area (paramedics); or (c) administer or supply an S2 or S3 poison under a drug therapy protocol.’. 13 Amendment of s 286 (Prohibition on dispensing or supplying poisons to child under 16) Section 286(2), before ‘registered’— insert— ‘isolated practice area paramedic,’. 14 Amendment of appendix 2A (Drugs an ambulance officer may obtain, possess and administer) (1) Appendix 2A, part 2— insert— ‘2B enoxaparin paramedic 4’. (2) Appendix 2A, part 2— insert — ‘4A heparin paramedics 3 and 4’. (3) Appendix 2A, part 2—

(2) Appendix 9— insert— ‘ isolated practice area paramedic means an ambulance officer who— (a) has successfully completed the training course, from James Cook University, Graduate Certificate of Rural and Remote Paramedic Practice that includes the Isolated Practice Area Paramedic course developed by the Northern Area Health Service Workforce Directorate; and (b) is classified by the Queensland Ambulance Service as a paramedic 3, 3 (ECP) or 4. isolated practice area (paramedics) means—
s 16 8 s 16 Health (Drugs and Poisons) Amendment Regulation No. 333, 2007 (No. 1) 2007 (a) a place that is at Cow Bay, Marpuna or Weipa; or (b) a place that is— (i) within— (A) the operational area of the Calen, Carmila, Finch Hatton, Glenden, Happy Valley Fraser Island, Marlborough, Nebo, Millaa Millaa or Wowan, Queensland Ambulance Service station; or (B) the area of a local government mentioned in appendix 5; and (ii) remote from pharmaceutical services; or (c) a clinic conducted by the Royal Flying Doctor Service (Qld section) in an area isolated from medical, pharmaceutical and hospital services. nursing home means a facility, other than a hospital or private residence, at which accommodation and nursing or personal care is provided to persons who, because of disability, disease, illness, incapacity or infirmity, have a continuing need for care. prison see the Corrective Services Act 2006 , schedule 4.’.
