s1 2 s5 Health (Drugs and Poisons) Amendment (No. 1) No. 8, 1999 ˙ Short title 1. This regulation may be cited as the Health (Drugs and Poisons) Amendment Regulation (No. 1) 1999 . ˙ Regulation amended 2. This regulation amends the Health(DrugsandPoisons)Regulation1996 . ˙ Insertion of new s 59A 3. After section 59— insert — ˙ ‘ Indigenous health workers ‘ 59A. An indigenous health worker, while practising in an Aboriginal or Torres Strait Islander community in an isolated practice area, is authorised— (a) to obtain and possess a controlled drug; or (b) to administer a controlled drug, under an approved drug therapy protocol, on a doctor’s oral or written instruction.’. ˙ Amendment of s 67 (Registered nurses) 4.(1) Section 67(3) and (4)— omit, insert — ‘ (3) To the extent necessary to practise nursing at a hospital within an isolated practice area, a registered nurse is authorised to supply a controlled drug, on a doctor’s oral or written instruction, to a person being discharged from the hospital or to an outpatient of the hospital.’. ˙ Replacement of s 164A (Indigenous health workers) 5. Section 164A— omit, insert —

An indigenous health worker, while practising in an Aboriginal or Torres Strait Islander community in an isolated practice area, is authorised— (a) to obtain and possess a restricted drug; or (b) to administer or supply a restricted drug, under an approved drug therapy protocol, on a doctor’s instruction.’. ˙ Amendment of s 175 (Registered nurses) 6.(1) Section 175(2A)— omit, insert — ‘ (2A) To the extent necessary to practise nursing at a hospital within an isolated practice area, a registered nurse is authorised to supply a restricted drug, on a doctor’s instruction, to a person being discharged from the hospital or to an outpatient of the hospital.’. (2) Section 175(5)— omit. ˙ Omission of s 188A (Naltrexone) 7. Section 188A— omit . ˙ Replacement of s 252A (Indigenous health workers) 8. Section 252A— omit, insert — ˙ ‘ Indigenous health workers ‘ 252A. An indigenous health worker, while practising in an Aboriginal or Torres Strait Islander community in an isolated practice area, is authorised to administer or supply an S2 or S3 poison under an approved drug therapy protocol.’.
s 9 4 s 10 Health (Drugs and Poisons) Amendment (No. 1) No. 8, 1999 ˙ Amendment of s 263 (Registered nurses) 9. Section 263(4)— omit, insert — ‘ (3) To the extent necessary to practise nursing at a hospital within an isolated practice area, a registered nurse is authorised to supply an S2 or S3 poison, on a doctor’s instruction, to a person being discharged from the hospital or to an outpatient of the hospital.’. ˙ Amendment of appendix 9 (Dictionary) 10.(1) Appendix 9— insert — ‘ “indigenous health worker” means a person who— (a) holds a Diploma of Health Science ATSI Primary Health Care (Generalist) ASF 5 from a college of technical and further education or an approved equivalent qualification; and (b) has successfully completed the North Queensland Rural Health Training Unit Isolated Practice Health (Drugs and Poisons) Regulation 1996 Course or an approved equivalent course of training for the accreditation of registered nurses for practice in an isolated practice area; and (c) practises in an Aboriginal or Torres Strait Islander community within an isolated practice area where there is no resident doctor or registered nurse.’. (2) Appendix 9, definition “isolated practice area”, paragraph (aa)— omit, insert — ‘(aa)a place that is at Cow Bay, Marpuna or Weipa; or’.
