(Amendment)

I, MICHAEL JOHN RANDAL MACKELLAR, the Minister of State for Health, hereby make the following Regulations under the Health Commission Ordinance 1975.

Interpretation

1. Regulation 2 of the Health Commission (Charges) Regulations is

amended—

(a) by omitting the definition of "nursing-home type patient" and substituting the following definition:

" 'nursing-home type patient', in relation to a hospital, means an in-patient of a hospital who has been such an in-patient for a continuous period exceeding 60 days, but does not include—

(a) an in-patient in respect of whom there is in force a certificate given under regulation 2B;

(b) an in-patient who, in the opinion of the Chief Medical Administrator of the hospital, has, or may have, a right to recover from another person, by way of compensation or damages, the cost of hospital accommodation; or

(a)	regulation 5,6 or 7 of the Interim Forces Benefits Regulations;
(b)	regulation 31, 32, 32B or 38 of the Repatriation (Far East
Strategic Reserve) Regulations;

(c) a non-eligible person;";

(b)	by omitting "Schedule 1 to the Health Insurance Act 1973, as in force on 1 November 1979" from the definition of "standard medical benefits table" and substituting "the Schedule to the Health Insurance (Variation of Fees and Medical Services) (No. 17) Regulations"; and
(c)	by adding at the end thereof the following sub-regulation:

"(6) In these Regulations, a reference to a private patient, shall, in

relation to medical treatment provided for a person in pursuance of—

(c)	regulation 31, 32, 32B or 38 of the Repatriation (Special Overseas Service) Regulations;
(d)	regulation 64, 65, 65A, 66 or 73 of the Repatriation Regulations; or
(e)	regulation 26, 26A or 34 of the Seamen's War Pensions and Allowances Regulations,

be read as including a reference to that person.".

Hospital fees

2. Regulation 3 of the Health Commission (Charges) Regulations is amended by omitting from sub-regulation (3A) " (not being a nursing-home type patient)".

Fees for nursing-home type patients in hospitals

3. Regulation 3 A A of the Health Commission (Charges) Regulations is

amended by omitting "or a non-eligible person" (wherever occurring).
Prescribed classes of persons for the purposes of sub-section 74 (3) of the
Ordinance

4. Regulation 9 of the Health Commission (Charges) Regulations is amended by omitting from paragraph (2) (b) "persons who are suffering from a disease" and substituting "persons who are provided with an ambulance service in relation to the diagnosis, treatment or control of a disease".

Other amendments

5. The Health Commission (Charges) Regulations are amended as set out

in the Schedule.
