Regulations under the Health Commission Ordinance 1975.*

hereby make the following Regulations under the Health Commission Ordinance
1975 .

H E A L T H C O M M I S S I O N ( C H A R G E S ) R E G U L A T I O N S

1 . These Regulations may be cited as the Heal th Commission (Charges)

Regulat ions.

2.   In these Regulations, unless the contrary intention appears—• " hospital p a t i e n t " means a patient in respect of whose t reatment or

accommodat ion in a hospital conducted by the Commission services
are rendered solely by the Commission;

" intensive nursing-home c a r e " means nurs ing-home care for a person who, by reason of infirmity, or any illness, disease, incapacity or disability, is bedridden or virtually bedridden and is wholly or sub­ stantially dependent upon nursing care or, by reason of the t reatment of any illness, disease, incapacity or disability, is wholly or sub­ stantially dependent upon nursing care;

" intensive-care patient " means a pat ient who requires intensive nursing-

home care;

" multiple-bed r o o m " means a room in which 2 or more beds are

si tuated;

" O r d i n a n c e " means the Health Commission Ordinance 1975;

" ordinary patient " means a patient other than an intensive-care patient;
" private p a t i e n t " means a patient other than a hospital patient;
" single room " means a room in which 1 bed is situated.

3 . ( 1 ) T h e following charges for the accommodat ion of patients (o ther than pat ients to whom sub-regulation (2 ) applies) in hospitals conducted by the Commiss ion are prescribed for the purpose of sub-section 74 (1 ) of the Ordi­ n a n c e : —

(a) for the accommodation of a hospital patient, at the patient's request,
in a single r o o m — $ 2 0 per day;
(b) for the accommodation of a private patient in a single room—$30

per day;

(c) for the accommodation of a private patient in a multiple-bed room
— $ 2 0 per day.

( 2 ) The prescribed charge for the purpose of sub-section 7 4 ( 1 ) of the Ordinance, for the accommodat ion, in a hospital conducted by the Commission, of a patient to whom this sub-regulation applies is $70 for each period of 24 hours or par t of such a period during which the pat ient is accommodated in the hospital.

( 3 ) Sub-regulation (2 ) applies to a patient who, in the opinion of the Chief Medical Adminis t ra tor of the hospital, has, or may have, a right to recover from another person, by way of compensat ion or damages, the cost of hospital accommodat ion.

( 4 ) Where a child whose age is less than 12 months and the mother of that
child are both accommodated in a hospital, they shall, for the purpose of sub-

regulation ( 1 ) , be treated as one patient unless the child and the mother both

receive treatment .

(5 ) Fo r the purpose of sub-regulation ( 1 ) , the day on which a patient is admitted to a hospital and the day on which the patient is discharged from that hospital shall be together reckoned as one day.

(6 ) For the purpose of sub-regulation ( 2 ) , " d a y " means the period of 24 hours commenc ing at the t ime at which a patient is admitted to a hospital.

(7 ) The prescribed charge, for the purpose of sub-section 7 4 ( 1 ) of the Ordinance, for the supply to a patient to whom sub-regulation (2 ) applies of surgical appliances specially made or obtained for that patient (not being appli­ ances implanted in the patient during surgical or medical t reatment) is the actual cost of the appliances.

4. T h e following charges for the accommodat ion of patients in nursing-

homes conducted by the Commission are prescribed for the purpose of sub­

section 7 4 (1 ) of the O r d i n a n c e : —

(a)

for the accommodation of an ordinary patient in a multiple-bed room—$91 .70 per week;

(b)

for the accommodation of an ordinary patient in a single room, other than a room referred to in paragraph ( c ) — $ 1 0 1 . 7 1 per week;

(c) for the accommodat ion of an ordinary patient in a single room equipped with bath, shower or toilet facilities—$112.72 per week;
(d) for the accommodation of an intensive-care patient in a multiple-
bed room—$112 .70 per week;

(e)

for the accommodation of an intensive-care patient in a single-bed room, other than a room referred to in paragraph ( f )—$122 .71 per week;

(f)

for the accommodation of an intensive-care patient in a single-bed room equipped with bath, shower or toilet facilities—$132.72 per week.

5. ( 1 ) In this regulation, " C rana After-care H o s t e l " means the hostel

situated in the Division of N a r r a b u n d a h and conducted by the Commission
under the n a m e " Crana ".

( 2 ) T h e prescribed charge, for the purpose of sub-section 7 4 ( 1 ) of the Ordinance, for the accommodat ion of a person in Crana After-care Hostel is $1.50 per day or part of a day.

6. (1 ) The prescribed charge, for the purpose of sub-section 74 (1 ) of the Ordinance , for the accommodat ion, in a hospital, nursing-home or hostel con­ ducted by the Commission, of a person other than a patient (not being a person to whom sub-regulation 3 (4) applies) i s—

(a ) for the first seven days—S3 per day; and
(b ) for subsequent days—$2 per day.

( 2 ) F o r the purpose of sub-regulation ( 1 ) , the day o n which a person begins to be accommodated and the day on which he ceases to be accommodated shall each be treated as one day.

7. (1 ) The prescribed charge, for the purpose of sub-section 74 (1 ) of the Ordinance , for the provision of an ambulance for a person i s —

(a)

if the distance necessarily travelled by the ambulance from its station and in returning to its station exceeds 16 ki lometres—the sum of an amount of $40 and an amount calculated at the rate of $1 for every ki lometre by which that distance exceeds 16 kilometres; and

(b ) in any other case—$40.

( 2 ) Where , at the request of a person or organization conducting a sporting event or other public function, an ambulance vehicle is made available on any day at the event or function, the prescribed charge, for the purpose of sub­ section 7 4 ( 1 ) of the Ordinance, is a sum calculated at the rate of $100 for every period of 8 hours, or part of such a period, during which the vehicle is so made available.

(3 ) Where an ambulance vehicle that has been made available at an event or function for the purpose of sub-regulation (1 ) is used for the transport of a person, sub-regulation (1 ) applies as if the place at which the event or function is conducted were the station referred to in that sub-regulation.

8. The prescribed charge, for the purpose of sub-section 7 4 ( 1 ) of the Ordinance, for a dental service specified in Co lumn 1 of the Schedule (not being a dental service rendered at a hospital conducted by the Commission) is the amount specified in Column 2 of the Schedule opposite to the description of the service.

9. The prescribed charge, for the purpose of sub-section 74 (1 ) of the
Ordinance , for the supply of copies of documents relating to the accommodat ion

or t reatment of a person at a hospital or nursing-home conducted by the Com­
