Act No. 78, 1976.

An Act to amend the Health Commission Act, 1972, in connection with the acquisition and disposal of property and in respect of ambulance services. [Assented to, 2nd December, 1976.1

BE it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as
follows: —

1. This Act may be cited as the "Health Commission

(Amendment) Act, 1976".

2. The Health Commission Act, 1972, is amended—

(a) by inserting at the end of section 3 the following subsection :—

(2) In this Act, a reference to an ambulance service is a reference to the work of rendering first aid to, and the transport of, sick and injured persons.

(b) by inserting after section 19 the following section :—
1 9A. (1) The Commission has power to acquire, and shall be deemed always to have had power to acquire, for the purposes of exercising or performing any of its powers, authorities, duties and functions under this or any other Act, any property by gift

inter vivos, devise or bequest and to agree to the

condition of any such gift, devise or bequest.

(2) The rule of law against the remoteness of vesting shall not apply, and shall be deemed never to have applied, to any such condition to which the Commission has agreed.

(c)

(i)

by inserting in section 20 after the word "this" the words "or any other";

(ii)

(ii)   by inserting at the end of section 20 the following subsection :—

(2) The Minister shall not approve of a sale or lease of, or dealing with, land, or of an exchange of land, acquired by the Commission where that sale or lease of, or dealing with or exchange of, land, as the case may be, would contravene a condition of a gift, devise or bequest to which the Commission has agreed.
