Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Health Care Liability Act 2001.

Explanatory note
The object of this Regulation is to amend the Health Care Liability Regulation 2001 to require dental prosthetists to hold professional indemnity insurance (subject to certain exemptions).
This Regulation is made under the Health Care Liability Act 2001, including sections 25 and

34 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Health Care Liability Amendment (Dental
Prosthetists) Regulation 2007.

2 Amendment of Health Care Liability Regulation 2001

The Health Care Liability Regulation 2001 is amended as set out in
Schedule 1.

Schedule 1 Amendments

(Clause 2)

[1]      Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

dental prosthetist has the same meaning as in the Dental
Technicians Registration Act 1975.

[2]      Clause 9 Classes of health practitioner required to be covered by professional indemnity insurance

Insert after clause 9 (b):

(b1) dental prosthetists,

Omit clause 12. Insert instead:

12 Interim exemption for health practitioners without insurance

(1)

A health practitioner who is not covered by professional indemnity insurance of any kind immediately before the relevant date is, in accordance with section 25 (5) of the Act, exempt from the requirement for professional indemnity insurance until the date 6 months after that date (or until such later date as the Minister may specify by order published in the Gazette).

(2) In this clause:
relevant date means, in respect of a health practitioner, the date
on which the class of health practitioner to which he or she
belongs became a class of health practitioner to which section 25
of the Act applies.
