Health Care (HPC—Appointment of Members) Regulations 2008

under section 9(3) of the Health Care Act 2008

1Short title

These regulations may be cited as the Health Care (HPC—Appointment of Members) Regulations 2008.

2Commencement

These regulations will come into operation on the day on which section 9 of the Health Care Act 2008 comes into operation.

3Interpretation

In these regulations—

Act means the Health Care Act 2008.

4Establishment of Health Performance Council (HPC)

For the purposes of section 9(3) of the Act—

  1. (a)

    the following are prescribed bodies:

    1. (i)

      Aboriginal Health Council of South Australia Incorporated;

    2. (ii)

      Australian Medical Association (South Australia) Incorporated;

    3. (iii)

      Carers SA;

    4. (iv)

      Consultative Council of Ex‑Service Organisations (SA);

    5. (v)

      Council on the Ageing (South Australia) Incorporated;

    6. (vi)

      Health Consumers Alliance of South Australia Incorporated;

    7. (vii)

      Multicultural Communities Council of South Australia Incorporated;

    8. (viii)

      Regional Communities Consultative Council (SA);

    9. (ix)

      Rural Doctors Association of South Australia Incorporated;

    10. (x)

      S.A. Divisions of General Practice Incorporated;

    11. (xi)

      The Flinders University of South Australia;

    12. (xii)

      The Returned & Services League of Australia (S.A. Branch) Incorporated;

    13. (xiii)

      The South Australian Country Women's Association Incorporated;

    14. (xiv)

      The University of Adelaide;

    15. (xv)

      University of South Australia;

    16. (xvi)

      Volunteering SA and NT Incorporated; and

  2. (b)

    the Minister is to consult with the prescribed bodies in relation to the selection of persons for appointment to HPC as follows:

    1. (i)

      when appointments are to be made to fill 2 or more vacancies, an invitation is to be extended to each prescribed body to recommend suitable candidates within a specified period;

    2. (ii)

      the invitation is to specify the number of persons to be appointed and invite each body to recommend a specified number of suitable candidates consisting, as far as practicable, of equal numbers of men and women;

    3. (iii)

      the invitation may specify areas of knowledge, expertise, experience, skills or qualifications listed in section 9(2) of the Act required of appointees and, if it does so, a recommendation of a candidate is to be accompanied by relevant information about the candidate's knowledge, expertise, experience, skills or qualifications.
