Part 1    Preliminary

1   Short title

This regulation may be cited as the Health and Other Legislation (Nursing and Midwifery) Amendment Regulation 2018.

2   Commencement

This regulation commences on 1 December 2018.

Part 2    Amendment of Child Employment Regulation 2016

3   Regulation amended

This part amends the Child Employment Regulation 2016.

4   Amendment of sch 3 (Dictionary)

(1)Schedule 3, definition midwife—

omit, insert—

midwife means a person registered under the Health Practitioner Regulation National Law to practise in the midwifery profession, other than as a student.

(2)Schedule 3, definition registered nurse, paragraph (a)—

omit, insert—

(a)to practise in the nursing profession, other than as a student; and

Part 3    Amendment of Child Protection (Offender Reporting and Offender Prohibition Order) Regulation 2015

5   Regulation amended

This part amends the Child Protection (Offender Reporting and Offender Prohibition Order) Regulation 2015.

6   Amendment of s 12 (Reports not made in person—Act, s 29(5))

Section 12(4), definition registered nurse, paragraph (a)—

omit, insert—

(a)to practise in the nursing profession, other than as a student; and

Part 4    Amendment of Coal Mining Safety and Health Regulation 2017

7   Regulation amended

This part amends the Coal Mining Safety and Health Regulation 2017.

8   Amendment of s 16 (Giving notice of incidents)

Section 16(3), definition nurse—

omit, insert—

nurse means a person registered under the Health Practitioner Regulation National Law to practise in the nursing profession, other than as a student.

Part 5    Amendment of Health (Drugs and Poisons) Regulation 1996

9   Regulation amended

This part amends the Health (Drugs and Poisons) Regulation 1996.

10   Amendment of appendix 9 (Dictionary)

(1)Appendix 9, definition enrolled nurse, paragraph (a), ‘and midwifery’—

omit.

(2)Appendix 9, definition midwife—

omit, insert—

Part 7    Amendment of Radiation Safety Regulation 2010

13   Regulation amended

This part amends the Radiation Safety Regulation 2010.
