AN ACT to amend the Health Act 1911-1981.

[Assented to 27 May 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Health 2,Tgan.

Amendment Act 1982.

(2) In this Act the Health Act 1911-1981 is approvedfo r

referred to as the principal Act.

The principal Act as amended by this Act may be cited as the Health Act 1911-1982.

Commence-

ment 2. The provisions of this Act shall come into

operation on such day or days as is or are respec-

tively fixed by proclamation.

Suction 10

repealed and 3. Section 10 of the principal Act is repealed and

substituted.	the following section substituted-
Deputy Com-

missioner. 10. The Governor may appoint a person to act as the deputy of the Commissioner and, where there is a vacancy in the office of Com- missioner or the Commissioner is absent or otherwise unable to perform the functions of that office, a person so appointed

(a)	is authorised to exercise any power or authority that the Commissioner may exercise; and
(b)	shall perform any duty that the Commissioner is required to perform,

under this Act. " .

Section 1 56

amended. 4. Section 156 of the principal Act is amended

by deleting "five miles" and substituting the

following-

" eight kilometres "

Section HO

amended.	5.	Section 160 of the principal Act is amended
(a) by deleting "meals are served" and sub- stituting the following-

" meals are prepared for service, or are

served, " ;

and

(b) by deleting "serving meals" and substitut- ing the following-

" the preparation for service or service of

meals " .

Section 164

6. Section 164 of the principal Act is amended amended.

(a)	in paragraph (c), by deleting "or";
(b)	in paragraph (d), by deleting "Rooms." and substituting the following-

" Rooms; or " ; and

(c) by adding the following paragraph-

" (e) (e) Take-away Food Premises. "

7. Section 172 of the principal Act is amended in aSm e eetlifilne 1 7 . . 2

subsection (1) by adding to the paragraph

designated "(1)" the following subparagraph-

" (v) Take-away Food Premises. " .

8. Section 241C of the principal Act is amended— Section 2410 amended.

(a) in subsection (2)-

(i)  by deleting "consist of" and sub- stituting the following-

" comprise " ; and

(ii)   by deleting paragraph (d), and sub- stituting the following

(d) one shall be the person who is for the time being the Secretary of the Committee,

together with such person or persons as the appointed members may for the time being co-opt to advise the Committee on trade requirements. " ;

(b) in subsection (4)-

(i) by inserting before "member", where

it first occurs, the following-

" appointed " ; and

(ii) by deleting "a member" and sub- stituting the following-

" that member " ;

and

(c) in subsection (5)-

(i)    by deleting "the other members", in paragraph (a), and substituting the following-

" the other appointed mem-

bers "

and

(ii)    by deleting "each member", in para- graph (b), and substituting the following-

" each appointed member, and in relation to matters in respect to which he is co-opted each co-opted member, " .

Section 241D

Section 241D of the principal Act is amended

in subsection (1) by deleting "fees" and substituting

the following-

Section 241E

repealed.	10.	Section 241E of the principal Act is repealed.
Section 247A

amended. 11. Section 247A of the principal Act is amended in subsection (3) by deleting "twenty-five miles" in paragraph (b) and substituting the following-

" forty kilometres " .

Section 3	7	12. Section 337 of the principal Act is amended
amended	.

in subsection (1)-

(a) by inserting after "medical officer", where it first

occurs, the following-

" or any nurse duly authorised in this

behalf by the Commissioner " ;

(b) by inserting after "school" the following—

" or child care centre " ;

and

(c) by inserting after "medical officer", where it last occurs, the following-

" or nurse " .

13. Section 337A of the principal Act is amended =odip.7A

in subsection (5)-

(a) by deleting "her duties as such, and where she practises any dentistry that she is so" and substituting the following

the duties of a school dental therapist, and where a school dental therapist practises any dentistry that a dental therapist is " ; and

(b) by deleting "neither she nor" and sub- stituting the following-

" neither the school dental therapist

nor " .

14. Section 340B of the principal Act is amended =ociaeci40B

in paragraph (b) of subsection (3) by deleting "State Branch of the Royal College of Obstetricians and Gynaecologists" and substituting the

following-

" Australian College of Obstetricians and

Gynaecologists (W.A. Branch) " .

15. Section 340AB of the principal Act is 4 L311

amended in paragraph (a) of subsection (4) by amended.

logists" and substituting the following-

340BB	16. Section 340BB of the principal Act is amended in paragraph (a) of subsection (4) by deleting "State Branch of the Australian Council of the Royal College of Obstetricians and Gynaecolo- gists" and substituting the following-
