HEALTH ADMINISTRATION ACT 1982—REGULATION

(Relating to disclosure of information)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of Health Administration Act 1982, has been pleased to make the Regulation set forth hereunder.

The Health Administration Regulation 1983 is amended:

(a) by inserting before clause 1 the following heading:

PART 1—PRELIMINARY

(b) by inserting before clause 3 the following heading:

PART 2—EMPLOYEES

(c) by inserting after clause 29 the following matter:

PART 3—GENERAL

Disclosure of information

30. (1) It is not an offence to disclose information referred to in

section 22 of the Act if:

(a) the information is epidemiological data; and

(b)

the disclosure is made in accordance with the written approval of the Chief Health Officer, Department of Health; and

(c)

that approval describes the information that is authorised to be disclosed and names the person or body to whom disclosure is authorised.

(2) Such an approval may be given subject to conditions, which

are to be specified in the approval.

(3) This clause is made pursuant to section 22 (e) of the Act.

EXPLANATORY NOTE

The object of this Regulation is to permit the disclosure of epidemiological data obtained in connection with the administration of the Health Administration Act 1982 (and certain other health and health related legislation) when the disclosure is made in accordance with the approval of the Chief Health Officer.
