776 ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 71 of 1964 An Act to Amend "The Health Acts, 1937 to 1962," in certain particulars [ASSENTED TO 24TH DECEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- I. (1) Short title . This Act may be cited as " The Health Acts Amendment Act of 1964." (2) Principal Act. " The Health Acts, 1937 to 1962 " are, in this Act, referred to as the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Health Acts, 1937 to 1964."
Health Acts Amendment Act of 1964, No. 71 777 2. Amendment to s, 3 . Section three of the Principal Act is amended by inserting before the words, brackets, letters and numerals " PART V- MISCELLANEOUS PROVISIONS (ss. 155-179) " the words, brackets, letters and numerals " PART IVC-SCIENTIFIC RESEARCH AND STUDIES (ss. 154M-154N)." 3. Amendment to s. 5 . Section five of the Principal Act is amended by omitting the definition " Meat" and inserting the following definition: "" Meat "-Any edible part of any cattle (including buffalo), sheep, pig, goat or bird, other than game, which is ordinarily used by man as food, whether fresh, chilled or frozen:". 4. Amendments to s. 106 . Section one hundred and six of the Principal Act is amended by, in subsection (1),- (a) adding to paragraph (a) the words " or any contraceptive or any fitting or appliance which is sold for use as a contraceptive or which is capable of being used as a contraceptive "; (b) inserting in paragraph (b) after the word " poison " the words " or any contraceptive or any fitting or appliance which is sold for use as a contraceptive or which is capable of being used as a contraceptive ". 5. Amendment to s. 1541. Section 1541 of the Principal Act is amended by, in subsection (2), inserting after the words " responsibilities of " in paragraph (d) the words " research into and concerning cancer and ". 6. New Part IVC inserted . The Principal Act is amended by inserting after Part IVB the following Part:- " PART IVC-SCIENTIFIC RESEARCH AND STUDIES [154M.] Authority to conduct scientific research and studies. If it appears to the Governor in Council that any person desires to conduct scientific research and studies for the purpose of reducing morbidity or mortality in the State, he may, by Order in Council published in the Gazette, authorize such person to conduct such research and studies under this Part. [154N.] Information obtained and reports made under this Part. (1) A person authorized under this Part and any person acting at his direction may- (a) seek and obtain information; and (b) receive reports, directed towards the research and studies such authorized person is conducting under this Part. A person shall not, by virtue of this provision, be compellable to supply any such information or make any such report. (2) A person shall not make use of or publish to any other person any information received or report made for the purpose of research and studies being conducted under this Part save in the conduct or for the purpose of such research and studies.
778 Health Acts Amendment Act of 1964, No. 71 Save as aforesaid, evidence of such information or report shall not be admissible in any action or proceeding before any court, tribunal, board, agency or person except with the approval of the Governor in Council. A witness in such an action or proceeding shall not be compellable, without his consent, to answer any question concerning any information supplied or report made by him to a person authorized under this Part or to a person acting at the direction of such authorized person for the purpose of research and studies being conducted under this Part. (3) An approval of the Governor in Council under the last preceding subsection shall be sufficiently proved in any action or proceeding if an instrument evidencing the same is proved as an instrument made by the Governor in Council in accordance with the provisions of " The Evidence Act of 1898 "."
