[ASSENTED TO 6TH DECEMBER, 1934.] THE HEALTH ACTS AMENDMENT ACT OF 1934. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Health Acts Short title * " AmTenhdemHeenatltAhct cotfs, A 11993040," to an1d93s1h,a"ll ' hbeerermeardefaesrroendetowiaths caonndstrqctl.Ou. the Principal Act. The Principal Act and this Act may collectively be cited as " The Health Acts, 1900 to 1934." Amendments of the Principal Act. 2. Section five of the Principal Act is amended Amendment by inserting after the definition of " Dairy Produce" the of s. 5. following new definitions, namely :- " " Director-General " --The Director-General of Director- Health and Medical Services for the State General. of Queensland; " Deputy Director-General " - The Deputy D~ puty Director-General of Health and Medical DGIerneecrtaolr.· Services for the State of Queensland." 3. For the due and effectual administration of ~ e~ ~ ~: f. tor- *" The Health Acts, 1900 to 1934," a Director-General of Health and Medical Services for the State of Queensland (hereinafter referred to as "The Director- General ") shall be appointed by the Governor in C<?uncil. The person holding office as Director-General of Health and Medical Services for the State of Queensland at the date of such Proclamation aforesaid shall, in addition and without prejudice to the terms and conditions of his appointment to such office, and without any further or other appointment be and be deemed to be the DIrector-General under and for the purposes of this Act. Director- General to administer Act under the Minister. (3.) The Director-General shall, under the Minister, be charged with the administration of *" The Health Acts, 1900 to 1934." Appointment of Deputy (4.) In addition to the appointment of a Director- Director- General as aforesaid a Deputy Director-General of General. Health and Medical Services for the State of Queensland (hereinafter referred to as "The Deputy Director- General ") shall be appointed by the Governor in Council. The person holding office as Commissioner of Public Health at the date of such Proclamation aforesaid shall without any further or other appointment be and be deemed to be the Deputy Director-General under and for the purposes of this Act. Delegation of powers, &c. (5.) The Director-General may from time to time with the approval of the Minister delegate any of his powers and duties (other than this power of delegation) to the Deputy Director-General or any other officer appointed under *" The Health Acts, 1900 to 1934," and may with like approval at any time revoke any such delegation either wholly or in part. During the period of such delegation the Deputy Director-General or other officer so delegated shall have and may exercise all such powers and authorities and shall discharge all such duties as are delegated to him, and shall for the purposes of so doing be and be deemed to be in all respects the Director-General. *64 Vic. HEALTH. 14985 1934. HeaUk Acts Amendment Act. (6.) Subject to this Act, on and from the date of Transfer of such Proclamation, and by virtue of and without notice powers, &c. other than *" The Health Acts Amendment Act of 1934"- (a) All powers, duties, authorities, rights, and liabilities conferred or imposed upon the Commissioner of Public Health before and existing at the date of such Proclamation shall be and be deemed to be conferred or imposed upon the Director-General. (b) All penalties, fees, fines, and forfeitures which at the date aforesaid are enforceable and recoverable by the Commissioner of Public Health shall and may be enforced and recovered by the Director-General. (c) All proceedings and things lawfully had and done by the Commissioner of Public Health shall be and continue to be in full force and effect to all intents and purposes as if the same had been had and done by the Director- General, and if the same are not completed may be continued and completed by the Director-General. (d) All actions and proceedings pending on the date aforesaid by or against the Commissioner of Public Health may be carried on and prosecuted by or against the Director-General, and no such action or proceeding shall abate or be discontinued or prejudicially affected by anything in *" The Health Acts Amendment Act of 1934" contained. (e) Where in the Principal Act or in any other Act or in any Proclamation, Order in.Council, regulation, by-law, order, or document a reference is made to the Commissioner of Public Health, such reference shall on and after the said date be and be deemed to be a reference to the Director-General." * This Act.
