Health Act and Food Act Amendment Act 1990, No. 59 969 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART 1-PRELIMINARY 1.1 Short title . This Act may be cited as the Health Act and Food Act Amendment Act 1990. PART 2-AMENDMENT OF HEALTH ACT 1937-1989 2.1 Citation . (1) In this Part the Health Act 1937-1989 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Health Act 1937-1990. 2.2 Amendment of s. 5. Interpretation . Section 5 of the Principal Act is amended by- (a) omitting the definition "Analyst" and substituting the following definition:- " "Analyst"-A person appointed under this Act as a State analyst or a person holding accreditation of a kind prescribed by the Director-General by notification published in the Gazette;"; (b) inserting in the definition "Drug dependent person", after the words "dangerous drugs", where thrice occurring, the words "or restricted drugs" in each case. 2.3 Amendment of s. 19. Local Authorities to see to the execution of regulations . Section 19 of the Principal Act is amended by omitting the second paragraph. 2.4 Amendment of s. 27. Section 27 of the Principal Act is amended by omitting from subsection (2) the words " analysts,". 2.5 Repeal of s. 28. Registration of analysts and premises. The Principal Act is amended by repealing section 28. 2.6 Amendment of s. 35. Temporary isolation places. Section 35 of the Principal Act is amended by omitting from subsection (2) the word "the" where it first occurs and substituting the word "The". 2.7 Amendment of s. 96 . Place for depositing refuse. Section 96 of the Principal Act is amended by omitting from subsection (1) the expression "," occurring after the word "refuse" and substituting the word "or".

Section 100A of the Principal Act is amended by omitting the first paragraph and substituting the following paragraph:- "The Director-General may, in accordance with this Act, make regulations in relation to premises in which any business is carried on that involves tattooing, ear piercing, acupuncture or any other process whereby the skin of a living person is penetrated.".. 2.9 Amendment of s. 132 . Entry and inspection . Section 132 of the Principal Act is amended by omitting from subsection (8) (d) the word "or" where it last occurs and substituting the word "of'. 2.10 Amendment of s. 178 . Evidence. Section 178 of the Principal Act is amended by omitting from paragraph (5) the word "communicable" and substituting the words "any notifiable". PART 3-AMENDMENT OF FOOD ACT 1981-1989 3.1 Citation. (1) In this Part, the Food Act 1981-1989 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Food Act 1981-1990. 3.2 Amendment of s. 26 . Duty of Local Authority. Section 26 of the Principal Act is amended by- (a) omitting subsections (2), (3), (4) and (5); (b) renumbering subsection (6) as subsection (2).
