I, PETER JOHN HOLLINGWORTH, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Hazardous Waste (Regulation of Exports and Imports) Act 1989.

1Name of Regulations

These Regulations are the Hazardous Waste (Regulation of Exports and Imports) Amendment Regulations 2003 (No. 1).

2Commencement

These Regulations commence on gazettal.

3Amendment of Hazardous Waste (Regulation of Exports and Imports) Regulations 1996

Schedule 1 amends the Hazardous Waste (Regulation of Exports and Imports) Regulations 1996.

5AParticulars of export of hazardous waste — metal alkyl compounds in hydrocarbons

For paragraph 18A (2) (a) of the Act, the following particulars are specified:

  1. (a)

    the hazardous waste to be exported is metal alkyl compounds in hydrocarbons;

  2. (b)

    the waste is stored by Qenos Pty Ltd, 16–20 Beauchamp Road, Matraville, NSW 2036;

  3. (c)

    15 tonnes of the waste is to be exported in the 12 months starting on the commencement of this regulation;

  4. (d)

    the waste will be stored in carbon steel tanks of 1 635-litre capacity and will be transported by road to Port Botany, Sydney;

  5. (e)

    at Port Botany, the tanks containing the waste will be loaded onto ships for transport to Antwerp in Belgium;

  6. (f)

    after unloading at Antwerp, the tanks will be transported by road to the holding facility of Indaver NV, Poldervlietweg, B-2030, Antwerp, Belgium;

  7. (g)

    the waste will be disposed of by Indaver NV, Poldervlietweg, B-2030, Antwerp, Belgium by:

    1. (i)

      high-temperature incineration; and

    2. (ii)

      repackaging of the residue followed by its disposal in a specially engineered landfill.

1. These Regulations amend Statutory Rules 1996 No. 284, as amended by 2001 No. 203.
