HAYS

v

DEPARTMENT OF COMMUNITIES AND JUSTICE & ANOR

[2023] HCASL 58
S11/2023

  1. The applicant seeks special leave to appeal from a decision of the Federal Circuit and Family Court of Australia (Division 1) Appellate Jurisdiction (Aldridge, Austin and Tree JJ) dismissing an appeal from the Federal Circuit and Family Court of Australia (Division 1) (Strum J). The application to this Court raises no question of principle and does not enjoy any prospects of success. Further, it is not in the interests of the administration of justice to grant special leave to appeal. Special leave should be refused. It would therefore be futile to grant the applicant's application, filed on 3 April 2023, for a stay of the orders made by the Federal Circuit and Family Court of Australia (Division 1) on 30 September 2022.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the applications.
