No. IV.

An Act to authorize and carry out an exchange

of certain Lands in the Town of Hay
between the Government and the Trustees

of the Hay Athenaeum. [8th July, 1887.]

WH E R E A S the Trustees and Committee of the Hay Athenaeum being the persons in whom the portion of land described in the First Schedule hereto is vested pursuant to notifications in the
Gazette of the tenth day of J u l y one thousand eight hundred and
sixty-eight and the twenty-second day of December one thousand
eight hundred and seventy-one have agreed to surrender to Her
Majesty the said portion of land with the buildings thereon in

order that the same may be used as the site for the new Court-house and buildings connected therewith on condition that a portion of land in the said town now used as the site of a Court-house and described in the Second Schedule hereto should be granted by Her Majesty for the purposes of an Athenaeum for the said town and be vested in the persons hereinafter named as Trustees for carrying out such purposes And whereas to give effect to such agreement and exchange the sanction

of Parliament is necessary Be it therefore enacted by the Queen's

Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales

in Parliament assembled and by the authority of the same as follows :—
1. The portion of land described in the First Schedule hereto
shall on the passing of this Act for the purpose of being used as the
site of a Court-house for the Town of Hay vest in Her Majesty

absolutely for an estate of inheritance in fee-simple in possession freed and discharged from all trusts whatsoever which might be deemed to

be annexed to the Trustees or persons in whom such portion of land was

heretofore vested And all contracts agreements liabilities obligations rights-of-way and easements whatsoever heretofore incident to or which might be deemed to be a charge upon the said portion of land whether at law or in equity are hereby extinguished and cancelled Provided that the said Trustees and persons are hereby declared to

be indemnified and held harmless in respect of any breach of trust
which they might be deemed to have committed in respect of the
surrender or agreement to surrender hereinbefore referred to.

2. The portion of land described in the Second Schedule hereto shall on the passing of this Act and for the purpose of being used as the site of an Athenaeum for the Town of Hay vest in the persons

hereafter

hereafter named by notification in the Gazette and their successors as Trustees of the said Athenaeum for an estate of inheritance in fee- simple upon such trusts and subject to such conditions as the Governor may prescribe and as may be expressed in such notification.

3. This Act may be cited as the " Hay Court-house (Site Acquisition) Act 1887 ."

the intersection of the eastern side of Pine-street with the southern side of Moppett- street and bounded thence on the north by part of the southern side of Moppett-street east three chains sixteen links thence on the east by a line south three chains sixteen links thence on the south by a line west three chains sixteen links to the eastern side of Pine-street aforesaid and thence on the west by part of that side of that street north three chains sixteen links to the point of commencement Being part of section twenty- six as shown on plan catalogued H 13 1694 in the Surveyor-General's Office.

County of Waradgery parish of Hay town of Hay area two roods six perches Commencing at the intersection of the southern side of Moppett-street with the western side of Lachlan-street and bounded thence on the north by part of the southern side of Moppett-street west three chains twenty and three-quarter links thence on the west by a line south one chain sixty-eight and one-sixth links thence on the south by a line east three chains twenty and three-quarter links to the western side of Lachlan-street afore­ said and thence on the east by part of that side of that street north one chain sixty- eight and one-sixth links to the point of commencement Being part of section twenty- six as shown on plan catalogued H 20 1694 in the Surveyor-General's Office.
