An Act to provide for the Dismantling of the Hawthorn and Kew Railway, and for other purposes.
Preamble
WHEREAS by The Railway Construction Act 1884 authority was given for the making and maintaining of the railway referred to in paragraph (56) of section three of the said Act and therein described as "A railway commencing on the Hawthorn and Lilydale Railway between Hawthorn and Auburn Railway Stations and terminating in the Borough of Kew in the line and upon the lands described in the Fifty-sixth Schedule hereto, to be called the Hawthorn and Kew Railway":
AND WHEREAS the said railway was in pursuance of the said authority duly constructed and opened for traffic on the nineteenth day of December One thousand eight hundred and eighty-seven:
AND WHEREAS since the sixth day of May One thousand nine hundred and fifty-seven no traffic has been conducted upon the said railway:
AND WHEREAS it is expedient to make provision as hereinafter enacted for the dismantling of the said railway and for other matters in relation thereto:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title
This Act may be cited as the Hawthorn and Kew Railway (Dismantling) Act 1958.
2.Authority to dismantle Hawthorn and Kew Railway and sell etc. property
(1)Notwithstanding anything in any Act The Victorian Railways Commissioners may—
(a)dismantle the hereinbefore recited Hawthorn and Kew Railway; and
(b)sell or otherwise dispose of or use for any purpose under Part III of the Railways Act 1928—
(i)the materials of which the said railway is constructed; and
(ii)any property vested in the said Commissioners and being in or upon the lands acquired or used in connexion with the said railway.
(2)The net proceeds of any sale or disposal of the said materials or the said property or any portion thereof shall be paid into the Railway Renewals and Replacements Fund.
