under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Hawkesbury Local Environmental Plan 1989

(Amendment No 125).

2      Aims of plan

The aims of this plan are to amend the Hawkesbury Local

Environmental Plan 1989:

(a)

to introduce a land use definition of “farm gate sales outlet”, and

(b)

to permit with the consent of the Council the use of land for farm gate sales outlets in Rural and certain Environmental Protection zones.

3      Land to which plan applies

This plan applies to all land within the City of Hawkesbury to which the Hawkesbury Local Environmental Plan 1989 applies.

4 Amendment of Hawkesbury Local Environmental Plan 1989

Hawkesbury Local Environmental Plan 1989 is amended as set out in Schedule 1.

(Clause 4)

[1]      Clause 5 Definitions

Insert in alphabetical order in clause 5 (1):

farm gate sales outlet means a building or place situated on land comprising part of a property and used for the sale and display for sale of agricultural products grown on the property, or products made from agricultural products grown on the property, but only if:

(a)

the sale and display for sale takes place in a building, part of a building or a defined area of land set aside for that purpose, and

(b)

the area of the building or land used for the sale and display for sale is not greater than 75 square metres, and

(c)

the building or land used is located more than 20 metres from a public road, and

(d)

a car parking area is provided in close proximity to the building or land.
