NO. IV.

AN ORDINANCE to repeal the Ordinance intituled " An

Ordinance for licensing Hawkers and Pedlers."

HEREAS it is expedient to prohibit the Trade of Hawking ;

Be it. therefore enacted by His Excellency the Governor of

Western Australia and its Dependencies by and with the Advice and

Consent of the Legislative Council thereof:

I.     THAT the Ordinance of the Legislative Council, 16th Victoria,

No. 2 of 1852, intituled An Ordinance for licensing Hawkers and Repeal of lath Via

.Pedlers, shall be and the same is hereby repealed.

II.      THAT from and after the Time that this Ordinance shall come

into Operation it shall not be lawful for any Hawker or Pedier or No Person to hawk Goods

under Penaky of ,C80.

other Person or Persons acting in that Capacity in City, Town, or Country, to vend, sell, or barter directly or indirectly, either by himself or other Person on his Behalf, any Goods, Chattels, Wares, or Mer- chandize, and every Person so vending, selling, or bartering, contrary to such Provision as last aforesaid, shall forfeit and pay any Sum not exceeding Thirty Pounds.

THAT Nothing herein contained shall prevent any Person Sort of Goods, Chattels, Ware, or Merchandize in any public Market or Fair, or from hawking from Door to Door in a City or Town or other- wise, any Fish, Game, Poultry, Butter, Milk, Eggs ,Matches, Brooms, Bread, Pastry, Confectionery, or Farm or Garden Produce, but such Person or Persons may do therein as they might lawfully have done before the Passing of this Ordinance, anything herein contained to the Contrary notwithstanding.

Shortening Ordinance.

IV.

THAT Sections A and C of " The Shortening Ordinance 18Z3," shall be incorporated with and taken to form a Part of this Ordinance, to all Intents and Purposes and in as full and ample a Manner as if the said Sections had been introduced and fully set forth herein.

Time of Operation-

V.

THAT this Ordinance shall come into Operation on and after the first Day of January next.
