HARTLEY GLASS PTY LTD ENTERPRISE AGREEMENT 2016

Application for approval of the Hartley Glass Pty Ltd Enterprise Agreement 2016.

[1] An application has been made for approval of an enterprise agreement known as the Hartley Glass Pty Ltd Enterprise Agreement 2016 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made Hartley Glass Pty Ltd T/A Hartley Glass. The agreement is a single-enterprise agreement.

[2] An undertaking has been given with respect to apprentices and is taken to be a term of the Agreement. A copy of the undertaking is attached to this Decision as Annexure A and can also be found at the end of the Agreement.

[3] Subject to the undertaking referred to above, I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.

[4] The Construction, Forestry, Mining and Energy Union (CFMEU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) of the Act I note that the Agreement covers these organisation.

[5] The Agreement was approved in Chambers on 31 October 2016 and, in accordance with s.54 of the Act, will operate from 7 November 2016. The nominal expiry date of the Agreement is 6 November 2019.
