GAUDRON J:   This application, arising under section 40(1) of the Judiciary Act, for the removal into this Court of proceedings currently pending before the Federal Court of Australia was considered by Justices Gummow, Kirby and myself. It has not been shown that in the circumstances of this case any question arises under the Constitution or involves its interpretation. Nor has it been shown that sufficient cause exists to remove the proceedings into this Court.

The application is dismissed.  I publish our joint reasons.
