MR M.J. BYRNE, QCIf the Court pleases, I appear for the applicant in this matter.  (instructed by the applicant)

MRS L.J. CLARE:   If the Court pleases, I appear for the respondent.  (instructed by Director of Public Prosecutions (Qld))

CALLINAN J:   Yes, Mr Byrne.

MR BYRNE:   Your Honours, at the risk of being repetitious, I simply rely upon the submissions I made in the previous matter.  There is nothing I can usefully add to what has been put before this Court in written submissions by the applicant himself.

CALLINAN J:   Thank you, Mr Byrne.  We need not hear you on this, Mrs Clare.

There is no reason to doubt the correctness of the decision of the court below and the application for special leave must be refused.

Adjourn the Court.
