2 Harbours (Weipa) Amendment (No. 1) No. 435, 1993 ˙ Short title 1. This by-law may be cited as the Harbours (Weipa) Amendment By–law (No. 1) 1993 . ˙ Amended by-law 2. The Weipa Harbour By-law published by the Gazette on 14 January 1978 is amended as set out in this by-law. ˙ Replacement of ss.1–3 3. Sections 1 to 3— omit, insert— ˙ ‘Short title ‘1. This by-law may be cited as the Harbours (Weipa) By-law 1978 . ’. ˙ Amendment of s.4 (Meaning of terms) 4.(1) Section 4, heading— omit, insert— ‘Definitions’. (2) Section 4, definition “Tonne” — omit . (3) Section 4— insert— ‘ “GRT” means gross registered tonnage; ’. ˙ Replacement of Part 2 (Harbour dues) 5. Part 2— omit, insert—

3 Harbours (Weipa) Amendment (No. 1) No. 435, 1993 ‘PART 2—HARBOUR DUES ˙ ‘Harbour dues ‘5.(1) Harbour dues are payable on a vessel (in the harbour) that is loading or unloading cargo. ‘(2) Harbour dues are payable at the rate set out in Schedule 1— (a) if the cargo weighs 10 000 t or less—on each tonne of the cargo; or (b) if the cargo weighs more than 10 000 t—on each ton of the vessel’s gross tonnage. 1 ˙ ‘Lay-up harbour dues ‘6.(1) Lay-up harbour dues are payable on a vessel (in the harbour) that is not loading or unloading cargo. ‘(2) Lay-up harbour dues are payable at the rate set out in Schedule 2. ˙ ‘Exemption from dues ‘7.(1) Harbour dues are not payable on coal, crude petroleum, residual oil or solar oil that is loaded on a vessel for refuelling purposes. ‘(2) Neither harbour dues nor lay-up harbour dues are payable on— (a) a fishing vessel; or (b) a private vessel that is less than 30 m long; or (c) a line launch, tug or other vessel that is performing functions on behalf of the Ports Corporation. ’. ˙ Insertion of new Schedules 1–2 6. After Part 6— 1 The tonnage of a vessel is expressed in imperial measurement, whereas the weight of its cargo is expressed in metric measurement.
