2 Harbours (Management of Harbour Works) Amendment (No. 1) No. 233, 1993 ˙ Short title 1. This order in council may be cited as the Harbours (Management of Harbour Works) Amendment Order (No. 1) 1993 . ˙ Commencement 2. This order in council commences on 1 July 1993. ˙ Amended order 3. The Harbours (Management of Harbour Works) Order 1992 is amended as set out in this order. ˙ Replacement of s.2 (Management of harbour works) 4. Section 2— omit, insert— ˙ ‘Management of harbour works ‘2.(1) The management and control of each harbour works described in Schedule 1 or 2 is vested in the person set out opposite the harbour works. ‘(2) The management and control of the harbour works includes— (a) the maintenance and replacement of pile moorings, buoy moorings and dinghy racks; and (b) the maintenance of roads, parking areas, amenities and gardens; and (c) maintenance dredging, other than dredging of channels to public jetties and public boat ramps. ‘(3) The management and control of the harbour works does not include the maintenance and replacement of— (a) public jetties; or (b) public boat ramps; or (c) breakwaters; or

3 Harbours (Management of Harbour Works) Amendment (No. 1) No. 233, 1993 (d) navigational aids. ‘(4) A reference in Schedule 1 or 2 to a plan is a reference to the plan held by the department. ˙ ‘Harbour works subject to conditions ‘3.(1) In this section— “due date” means 30 June or 31 December in each year. ‘(2) The Harbours Corporation must transfer the amount calculated under this section from its boat harbour account for the relevant boat harbour to its mooring levies account. ‘(3) The transfer must be made on or before each due date. ‘(4) The amount set out in Schedule 3 is to be transferred for each mooring that— (a) forms part of the harbour works described in Schedule 2; and (b) existed on the last due date. ‘(5) However if a mooring was established less than 6 months before the last due date, a pro rata amount is to be transferred. Example— If the mooring was established 1 month before the last due date an amount equivalent to one-sixth of the fee set out in Schedule 3 is payable. ’. ˙ Insertion of new Schedules 2 and 3 5. After the Schedule— insert—
