3 Harbours (Mackay Port Authority) Amendment No. 398, 1992 (No. 1) ˙ Short title 1. This by-law may be cited as the Harbours (Mackay Port Authority) Amendment By-law (No. 1) 1992 . ˙ Commencement 2. This by-law commences on 1 January 1993. ˙ Amended by-law 3. The Mackay Port Authority By-law 1988 is amended as set out in this by-law. ˙ Replacement of s.1.1 (Short title) 4. Section 1.1— omit, insert — ˙ ‘Short title ‘1.1 This by-law may be cited as the Harbours (Mackay Port Authority) By-law 1988 . ’. ˙ Amendment of s.1.5 (Interpretation) 5. Section 1.5— insert— ‘ “GRT” means gross registered tonnage; “length” of a vessel means the distance from the forepart of the vessel’s stem to the aft side of the vessel’s tuck or stern; “prescribed form” means a form approved by the Authority under section 1.7; “TEU” means a container measuring 20 ' by 8 ' by 8 '; ’.

Section 1.7— omit, insert— ˙ ‘Approval of forms ‘1.7 Forms prescribed or authorised by the Act or this by-law may be approved by the Authority. ’. ˙ Amendment of s.2.1 (Charge for copy of by-laws) 7. Section 2.1— omit all words from ‘ shall ’ to ‘ time to time ’, insert ‘ is prescribed in Schedule 4 ’. ˙ Amendment of s.5.3 (Application for berth) 8. Section 5.3(i)— omit ‘ shall be in Form 1 of the Schedule to this by-law ’, insert ‘ must be in the prescribed form ’. ˙ Replacement of s.5.44 9. Section 5.44— omit, insert— ˙ ‘Vendor’s licence ‘5.44(1) A person must not hawk, sell or barter goods or services on Authority land without a vendor’s licence (a “licence” ). ‘(2) A person may sell goods or services to the Authority without a licence. ‘(3) A person may sell newspapers, magazines and books on Authority land without a licence if the person has the consent of an authorised officer. ‘(4) An application for a licence, or the renewal of a licence, under this by-law must be—

5 Harbours (Mackay Port Authority) Amendment No. 398, 1992 (No. 1) (a) made to an authorised officer in the prescribed form; and (b) be accompanied by the fee set out in Schedule 4. ‘(5) An authorised officer may issue a licence to an applicant, or renew an applicant’s licence, subject to conditions and for a term the authorised officer considers appropriate. ‘(6) If the Authority is satisfied that the holder of a licence has breached a condition of the licence, the Authority may cancel or suspend the licence. ’. ˙ Omission of Schedule to by-law No. 5 10. Schedule to by-law No. 5— omit. ˙ Replacement of s.6.4 (Licence fees) 11. Section 6.4— omit, insert— ˙ ‘Licence fees ‘6.4 An application for a tug licence, or a renewal of a tug licence, must be accompanied by the fee set out in Schedule 4. ’. ˙ Omission of Schedule of charges 12. After section 6.9 (Schedule of charges)— omit. ˙ Amendment of s.7.3 (Tonnage rates and mooring dues on vessels) 13.(1) Section 7.3— omit ‘ Schedule “A” ’, insert ‘ Schedule 1 ’.

6 Harbours (Mackay Port Authority) Amendment No. 398, 1992 (No. 1) (2) At the end of section 7.3— insert— ‘(2) Tonnage rates are not payable in relation to a passenger cruise liner. ’. ˙ Amendment of s.7.4 14.(1) Section 7.4— omit ‘ Schedule “A” ’, insert ‘ Schedule 2 ’. (2) Section 7.4— insert— ‘(2) Mooring dues are not payable in relation to a pleasure yacht that is berthed for less than 1 hour for the purpose of loading stores or fuel. ‘(3) In this section— ‘ “pleasure yacht” has the meaning given by the Queensland Marine Act 1958 . ’. ˙ Amendment of s.7.7 (Arrival of vessel to be reported) 15. Section 7.7(ii)— omit all words from ‘ form ’ to ‘ purpose ’, insert ‘ prescribed form ’. ˙ Amendment of s.7.10 (Import, export, transhipment and special harbour dues) 16.(1) Section 7.10(i)— omit ‘ Schedule “B” ’, insert ‘ Part A of Schedule 3 ’. (2) Section 7.10(ii)— omit ‘ Schedule “C” ’, insert ‘ Part B of Schedule 3 ’. ˙ Amendment of s.7.11 (Rates on goods—how levied) 17.(1) Section 7.11(ii)—

7 Harbours (Mackay Port Authority) Amendment No. 398, 1992 (No. 1) omit all words from ‘ the goods in a container ’ to ‘ Schedule “C” ’, insert ‘ goods, other than meat, in a container, harbour dues are payable in accordance with Part B of Schedule 3 ’. (2) Section 7.11(ii)— omit ‘ Schedule “B” ’, insert ‘ Part A of Schedule 3 ’. ˙ Replacement of s.7.18 (Cargo of vessels) 18. Section 7.18— omit, insert— ˙ ‘Cargo of vessels ‘7.18(1) A person must not place goods, or allow goods to remain, on a wharf or in a warehouse under the Authority’s control, unless the person has the Piermaster’s consent. ‘(2) If the Piermaster has consented, the goods may remain on the wharf or warehouse— (a) for 2 weeks—free of charge; and (b) after 2 weeks—for the storage charge set out in Schedule 4. ’. ˙ Omission of Schedules A, B, C and D to by-law No. 7 19. Schedules A, B, C and D to by-law No. 7— omit. ˙ Amendment of s.8.1 (Interpretation) 20. Section 8.1 (definition “length” )— omit. ˙ Amendment of s.8.4 (Granting of mooring licences or mooring permits) 21. Section 8.4(iv)—

Section 8.9— omit all words from ‘ The dues ’ to ‘ dues shall be ’, insert ‘ The prescribed fee is ’. ˙ Omission of Schedule 2 to by-law No. 8 23. Schedule 2 to by-law No. 8— omit. ˙ Amendment of s.8A.7 (Prescribed fees) 24. Section 8A.7(i)— omit ‘ shall be as set forth in the Schedule and ’, insert ‘ , set out in Schedule 4, ’. (2) Section 8A.7(ii)— omit ‘ shall be as set forth in the Schedule and ’, insert ‘ , set out in Schedule 4, ’. ˙ Omission of Schedule to by-law No. 8A 25. Section 9.5— omit ‘ form of the Schedule to this by-law, ’, insert ‘ prescribed form ’. ˙ Replacement of s.9.10 (Fees payable) 28. Section 9.10— omit, insert— ˙ ‘Removal fee ‘9.10 A permittee must pay the prescribed fee to the Authority for the material removed. ’. ˙ Omission of Schedule to by-law No. 9 29. Schedule to by-law No. 9— omit.
