2 Harbours (Harbour Dues Guidelines) No. 468, 1993 ˙ Short title 1. This regulation may be cited as the Harbours (Harbour Dues Guidelines) Regulation 1993 . ˙ Definition 2. In this regulation— “Brisbane CPI” means the all groups consumer price index for Brisbane of the Australian Statistician. ˙ Guidelines 3. The guidelines for the purposes of section 136B of the Act are set out in the Schedule.
3 Harbours (Harbour Dues Guidelines) No. 468, 1993 ¡ SCHEDULE GUIDELINES section 3 ˙ Increase in harbour dues 1. A harbour due for a Board harbour may be increased if the proposed percentage increase for the harbour due is not more than the increase between— (a) the Brisbane CPI number last used for an increase or decrease in the harbour due; and (b) the Brisbane CPI number used for the proposed increase in the harbour due. ˙ Rationalising harbour dues 2.(1) This clause applies if— (a) related harbour dues for a Board harbour are to be rationalised; and (b) because of the rationalisation, revenue to the Board from the related harbour dues may increase. (2) Related harbour dues may be rationalised if the expected percentage increase on the previous year’s revenue because of the rationalisation is not more than the increase that would have resulted if each harbour due involved in the rationalisation had been increased by a percentage not more than the difference between— (a) the Brisbane CPI number last used for an increase or decrease in the harbour due; and (b) the Brisbane CPI number used for the proposed rationalisation of harbour dues.
4 Harbours (Harbour Dues Guidelines) No. 468, 1993 ˙ Special harbour dues—Abbot Point Harbour 3. The Ports Corporation may amend a special harbour due for Abbot Point Harbour if the amendment changes the amount of the harbour due in a way that conforms with a pricing formula agreed between the Ports Corporation and users of the harbour facilities. ˙ Other changes in harbour dues 4. A harbour due may be— (a) abandoned or decreased; or (b) fixed for a matter to replace a general harbour due for the matter; or (c) linked to related harbour dues under clause 2 and the linked harbour dues rationalised in a way that results in an expected decrease on the previous year’s revenue in the related harbour dues because of the rationalisation. ˙ Consultation 5.(1) A Board must consult with each entity the Board considers may be affected by— (a) an increase in a harbour due; or (b) a proposed new harbour due; or (c) a rationalisation of related harbour dues. (2) Consultation with a port advisory body that includes a representative of an entity likely to be affected in a way mentioned in subclause (1) is taken to be consultation with the entity.
