An Ordinance to provide for the establish- ment of a Scale of Pilotage Fees and Light Dues.

HEREAS by the first section of an Ordinance passed in the prcuabh,

wninth year of the Reign of- Her present Majesty, intituled

"an Ordinance to amend an Act intituled an Act for the regulation of pilotage and shipping in the harbours of Western Australia,'" it is enacted, that from and after the passing of the said Ordinance, in

any regulations to be promulgated with respect to any of the ports, harbours or anchorages of this colony, no pilotage fees or harbour dues shall be appointed to be paid ; and whereas it is deemed expe- dient to reestablish some of the said charges on a reduced scale; Be it therefore enacted, by His Excellency the Governor of Western

II. AND be it enacted, that in any such regulations as afore-

with the advice of the Executive Council, to establish, rescind or alter the scale of pilotage fees or dues alluded to in the second section of the Act for the regulation of the pilotage and shipping in the har- bour of this colony, provided that the charges in such scale shall in no case exceed those contained in the schedule appended hereto.

a scale of Light Dues. tower erected on the island of Rottnest for that purpose, and it is also probable that similar lights may be constructed in other parts of the said colony ; Be it enacted, that when and so soon as any light shall be established at Rottnest or elsewhere in the said colony, it shall be lawful for His Excelency the Governor, with the advice of the Executive Council, by any proclamation to be by him issued for that purpose from time to time, to establish a scale of light dues not exceeding the rate of three pence per ton, with reference to the regis- tered tonnage and cargo, the registred tonnage to be paid by each ship or vessel coming into any port or harbour or anchorage in the said colony, in the vicinity of which any such light has been estab- lished.

Coasting Vessel may V. AND be it enacted, that the owner of any ship or vessel

compound, bona fide engaged in the coasting trade of this colony, may pay a

fixed annual sum, to be agreed upon, in proportion to the tonnage of such ship or vessel, instead of paying the said dues for each entry

into any port, harbour or anchorage as above mentioned, provided that such fixed sum shall not in any case be less than one pound nor exceed three pounds in the year for the lights of any one port.

VT. AND be it enacted, that the condition of the bonds required Condition of Bond,

by the said Ordinance for the regulation of pilotage and shipping in the harbours of this colony, from the masters or commanders of any ship or vessel entering any of the same, shall from and after the passing of this Ordinance, be as follows, that is to say, -the condition of the above written bond is such that if the said (master or commander) do well and truly observe and obey, pay and discharge all and every the requisitions and prohibitions (relative to the conduct of masters or commanders of merchant ships in or off any of the ports, harbours or anchorages of the said colony) pilotage fees, harbour or light dues, and all the rates, fees and dues contained and imposed respectively in and by any Ordinance of the Legislative Council of the said colony now in force relative to the aforesaid port, or in and by every existing regulations affecting the said port issued by any Governor or acting Governor of the said colony under authority of any such Act of Council, then the said bond shall be null and void, but otherwise shall be in full force and effect.
