W H E R E A S by an Act passed by the Governor and Legislat ive Council of New South "Wales in t he four th year of t h e reign of
H e r Majesty Queen Victoria in t i tu led "An Act to amend an Act
" Intituled 'An Act for the better preservation of the Ports Harbours

" ' Havens Roadsteads Channels Navigable Creeks and Rivers in New " ' South Wales and the better regulation of Shipping in the same' " it was amongs t other t h ings the reby enacted tha t if t h e mas te r or com­ mande r of any ship or vessel abou t to leave any of t he por t s or har­ bours of t h e Colony of New South Wales should permi t any person to embark on board his ship or vessel whose n a m e had no t been entered in t he list requi red by a n Act in t i tu led " An Act for the better prcser-

t h e pr incipal officers of H e r Majesty 's Cus toms or of H e r Majesty 's

A t to rney Genera l of t he said Colony and whereas i t is expedient t h a t any J u d g e of t h e Supreme Cour t of New South Wales should possess a power of reduc ing t h e above s u m of one h u n d r e d pounds to meet any c i rcumstances of an ex tenua t ing charac ter in the cases in which i t m a y be recoverable Be it therefore enacted by H i s Excel lency the Governor of N e w South Wales wi th t h e advice of t he Legislat ive Council thereof Tha t from and after t he pass ing of th i s Ac t i t shall and m a y be lawful for t h e J u d g e before w h o m any such case shall be heard or determined to reduce the said s u m or pena l ty of one hundred pounds to any s u m no t less t h a n t en pounds to which in his discretion

he m a y t h i n k proper to reduce it.
