Part 1—Preliminary

1—Short title

These regulations may be cited as the Harbors and Navigation Variation Regulations 2006.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Harbors and Navigation Regulations 1994

4—Variation of Schedule 4—Restricted areas—controls

Clause 2, entry relating to Thistle Island Areas 1 and 2—delete the entry and substitute:

Thistle Island Areas 1 and 2

Control 10 but the prohibition on fishing does not apply in respect of the taking of abalone in Area 2 in accordance with a licence under the Fisheries Act 1982.

5—Variation of Schedule 5—Restricted areas—delineation

Schedule 5, entry relating to Thistle Island Area 2—delete the entry and substitute:

Area 2: the portion of the waters of Spencer Gulf bounded as follows: commencing at high water mark near Horny Point at a point at latitude 35°00'13.860" south, longitude 136°11'23.744" east, then east north east in a straight line to a point at latitude 35°00'00.000" south, longitude 136°12'42.495" east, being the intersection of that line with the western circumference of a circle of radius 2 nautical miles centred on a point at latitude 35°00'02.280" south, longitude 136°15'08.778" east, then clockwise from that intersection around the circumference to a point on the western circumference of the circle at latitude 35°01'02.251" south, longitude 136°13'01.891" east, then west in a straight line to high water mark at latitude 35°01'02.251" south, longitude 136°11'36.068" east, then north along high water mark to the point of commencement (all positions being in the WGS84 datum).

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
