CaseChat Overview and Summary

The applicant, Hansen Yuncken Pty Ltd, sought approval of the Enterprise Agreement 2017 from the Fair Work Commission. The respondent, United Voice, a union representing certain employees, opposed the application on the basis that the agreement did not comply with section 232 of the Fair Work Act 2009. The dispute centred on the terms of the agreement, particularly those related to penalty rates and shift allowances.

The primary legal issue before the court was whether the enterprise agreement met the statutory requirements set out in section 232 of the Fair Work Act. Section 232 mandates that an enterprise agreement must provide for terms and conditions of employment that are no less favourable than the applicable award or registered agreement. The court needed to determine if the terms of the agreement were consistent with this requirement, particularly in relation to penalty rates and shift allowances, which were the subject of contention between the parties.

The court examined the provisions of the agreement and found that they were compliant with section 232. It concluded that the terms of the agreement did not disadvantage employees in relation to penalty rates and shift allowances, as compared to the applicable award. The court was satisfied that the agreement provided for fair and reasonable terms of employment and met the statutory requirements. Consequently, the court approved the enterprise agreement.

The Fair Work Commission approved the Enterprise Agreement 2017 of Hansen Yuncken Pty Ltd, finding it compliant with the statutory requirements of the Fair Work Act. The court's decision affirmed the terms of the agreement, which were deemed fair and reasonable for the employees. The approval ensures that the agreement will govern the employment conditions of the employees as intended.
