ORDER

CATCHWORDS

On dismissal by consent of an application in a proceeding on the commercial list, a new mention date fixed to review the proceeding after the next step should be completed.

HIS HONOUR:  An order is made in terms of the initialled draft, which the Court assumes is acceptable to all parties affected.  The document provided does not show signatures of the solicitors for the first, second or fifth defendants.  The effect of the order which I've initialled is to dismiss an application listed for hearing today.  The proceeding is in the commercial list, rendering it appropriate, so that management by the Court can continue, to fix another date for mention and review.

That be the 18th of February 2013, given that there's currently on foot an order made by Judge McGill while I was on vacation contemplating, an order that a particular step might be taken by 15th February 2013.  After the ensuing weekend it would be known what, if anything, eventuates.

Paragraph 3 of the draft order provides for the proceeding to be mentioned on the 18th of February 2013.

Order as per initialled draft.
