MASON CJ:  Mr Dwyer, it looks as if it would be impossible

to conclude this application for special leave to

appeal by the time that the Court would have to

adjourn this afternoon which would be 4.40 pm. In
the circumstances, it seems that we have no
alternative but to stand this matter over to the

next special leave day in Melbourne, unless the
parties would be willing to present their arguments

in writing.

MR DWYER:  I think we would sooner that the matter be stood

over to the next special leave day in Melbourne, if

the Court please.
