An Act to regulate for a limited t ime the Exportat ion of Gunpowder and Warlike Stores from the Colony of New South Wales.

WH E R E A S the duration of the " Gunpowder Expor t Restriction Act of I860" was limited to a period of two years from the date of the passing thereof And whereas it is expedient again to regulate for

a l imited time the Exportat ion of Gunpowder and War l i ke Stores from the Colony of New South W a l e s Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South W a l e s in Par l iament assembled and by the authori ty of the same as follows:—

1. During the continuance of this Act no vessel having Gunpowder or W a r l i k e Stores on board in greater quanti ty than may in the opinion of the Collector or Chief Officer of Customs at the port of clearance bo required for the ordinary use and service of such vessel or of any passenger proceeding thereby shall be cleared at any port in the said Colony without a license under the hand of the Governor or of the Colonial Treasurer And any Gunpowder or W a r l i k e Stores shipped contrary to this Ac t shall be forfeited.

2. Before any Gunpowder or W a r l i k e Stores shall be shipped under any such license as aforesaid the shipper thereof shall be required to state in writing the name of the place at which it is intended they shall be landed and to give security by bond for five hundred pounds or treble the amount of the value of the Gunpowder or W a r l i k e Stores so shipped if it shall exceed that amount with two sufficient sureties being resident householders to the satisfaction of the Collector or Chief Officer of Customs at the port of clearance tha t such Gunpowder or W a r l i k e

Stores as the case may be shall be landed at the place for which they are declared to be shipped the proof of which shall lie upon the shipper thereof by the production of the certificate of the Collector or other Chief Officer of Customs or Consul or other public officer at the place where landed or such other proof as shall satisfy the Collector or other Chief Officer of Customs at the place of shipment within a reasonable t ime to be mentioned in such bond and in failure thereof the shipper shall be liable to a penal ty of five hundred pounds to be recovered at the suit of such Collector or Chief Officer of Customs or of H e r Majesty's At torney General in the Supreme Court of New South W a l e s and tha t in default of payment of such penalty by the said shipper it shall be lawful for the said Collector or Chief Officer or At torney General to p u t the said bond in suit in the said Court and to recover such amount or value as the case may be by information or otherwise.

3. All sums recovered in vir tue of this Act shall go and be paid to the Colonial Treasurer for the purposes of the Consolidated Revenue of the said Colony.

4. This Ac t shall come into effect from the passing thereof and shall continue in force for two years thereafter and shall be styled and may be cited as the " Gunpowder Expor t Restriction Act of 1862."
