An Act to regulate for a limited t ime the Expor­
tation of Gunpowder and Warlike Stores

from the Colony of New South Wales. [4th

WH E R E A S aga in to regu la te for a l imited t ime the expor ta t ion of Gun­
ci rcumstances have arisen which render i t expedient
Legisla t ive Assembly of N e w South Wales in Pa r l i amen t assembled

and by the au tho r i t y of t he same as follows :—

1. D u r i n g the con t inuance of th i s Ac t n o vessel hav ing Gun­

powder or W a r l i k e Stores on board in greater quan t i t y t han m a y in t h e opinion of t he Collector or Chief Officer of Customs a t the por t of c learance be requ i red for t h e ord inary use and service of such vessel shall be cleared a t any por t in t h e said Colony wi thou t a l icense

unde r t h e h a n d of t h e Governor or of t h e Colonial Treasurer .

2.   Before any Gunpowder or W a r l i k e Stores shall be shipped u n d e r

any such license as aforesaid t h e shipper thereof shall be requi red to give securi ty by bond for five h u n d r e d pounds or t reb le t h e a m o u n t of

the va lue of t h e Gunpowder or W a r l i k e Stores so shipped if i t shall

exceed tha t a m o u n t wi th two sufficient suret ies be ing res ident house­ holders to t h e satisfaction of t h e Collector or Chief Officer of Cus toms a t t he por t of c learance t h a t such Gunpowder or W a r l i k e Stores as t h e case m a y be shall be landed at t h e place for which i t is declared to be shipped t h e proof of which shall lie upon the shipper thereof by the product ion of t he certificate of t he Collector or o ther Chief Officer of Cus toms at t he place where landed or such o the r proof as shall satisfy t he Collector or other Chief Officer of Cus toms at t he place of sh ipment wi th in a reasonable t ime to be ment ioned in such bond and in failure thereof t h e shipper shall be l iable to a pena l ty of five hund red pounds to be recovered a t t he suit of such Collector or Chief Officer of Cus toms or of H e r Majesty 's A t to rney Genera l in the Supreme Cour t of N e w South Wales and t h a t in default of paymen t of such pena l ty by the said shipper i t shall be lawful for t h e said Collector or Chief Officer or A t to rney Genera l to p u t t h e said bond in suit in t he said Court and to recover such a m o u n t or value as t he ease may be by information or otherwise.

3 . A l l sums recovered in v i r tue of th is Ac t shall go and be pa id

to t h e Colonial Treasurer for the purposes of t h e Consolidated R e v e n u e
of t he said Colony.

4. This Ac t shall come in to effect from t h e passing thereof and shal l con t inue in force for two years thereafter and shall be styled and may be cited as t he " Gunpowder E x p o r t Rest r ic t ion Ac t of 1860 . "
