WHEllEiVS it is expedient to amend the Act fortieth Victoria number one being the " Gunpowder and Explosives Consolida­ tion Act of 1876" so as to empower the Governor with the advice of

the Executive Council to prescribe the rates of lighterage delivery and storage of explosives Be it thei'efore enacted by the Queen's Most

Excellent Majesty by and with the advice and consent of the Legis­

lative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—

1. Notwithstanding anything in the Act fortieth Victoria number one or in the Schedules thereto the Governor with the advice of the Executive Council may by regulations to be published in the Govern­ ment Gazette prescribe the rates and charges for lightering delivering and storing any explosive within the meaning of the said Act And from and after the publication in the Gazette of any such regulation the rate or charge thereby prescribed shall for all purposes he substituted

for the original rate or charge specified in the Third Eourth or Fifth
Schedule to the said Act and may be levied and enforced thereunder.
