An Act to consolidate and amend the Law regulating* the importation storage and removal of Gunpowder and other explosive substances. [27th June, 1876.]
W H E R E A S divers A c t s are now in force in the Colony of N e w South W a l e s for
have been passed from t ime to t i m e and
r egu la t i ng t he l and ing storage and subsequent removal of gunpowder
from t h e Magazines established a t Goat I s land in t h e H a r b o u r of P o r t Jackson a n d elsewhere in t he said Colony b u t t h e said Ac t s do no t apply to m a n y other dangerous explosive substances some of which have been invented or discovered since t he said Acts were passed A n d whereas all gunpowder impor ted in to t he Colony is required by law to be landed a t t he Colonial Gunpowder Magaz ine a t Goat I s l and in t h e H a r b o u r of P o r t J ackson b u t t he re is no enac tmen t expressly r equ i r i ng t h e storage of t he same in the said magazine A n d no gunpowder can legally be landed from any magazine in any pa r t of t he said ha rbour o ther t h a n a t t h e po in t near Dawes ' Ba t t e ry bo th of which appointed places are in dangerous proximi ty to populous neighbourhoods A n d the said Acts are in o ther respects defective A n d i t is therefore expedient to m a k e o the r provisions respect ing the impor ta t ion landing storage and removal of gunpowder and of other explosive substances and otherwise to amend t h e said Acts Be i t therefore enacted by t h e Queen ' s Mos t Exce l len t Majesty by and wi th t he advice and consent of t h e Legis la t ive Council and Legislat ive Assembly in th is present Pa r l i amen t assembled and by author i ty of the same as follows ( tha t is to s ay )—
3. This A c t shall come in to operat ion on the first day of October one thousand eight hundred and seventy-six bu t t he Governor m a y a t any t ime after t he pass ing hereof issue any proclamat ion herein author ized or m a k e any appo in tmen t s or regula t ions for t he purpose of ca r ry ing into effect the in tent ion and objects of th is Ac t . Tnternretation 1 . This A c t m a y be cited in all legal proceedings as t h e
" G u n p o w d e r and Explosive Consolidation Ac t of 1 8 7 6 . "
2. E r o m and after t h e commencement of th is A c t the several
Acts ment ioned in t he E i r s t Schedule hereto shall be and t h e same are repealed B u t no th ing here in contained shal l affect any proceeding
m a t t e r or t h i n g lawfully done or any liabil i ty for storage r e n t or
charges incur red unde r e i ther of t he said Acts A n d all offences com- mi t ted against thei r enac tmen t s may be prosecuted and the penal t ies enforced as if th is Ac t h a d no t been passed Provided always t h a t no th ing in this Ac t contained shall affect t he Ac t thirty-fifth Victoria n u m b e r one in t i tu led "An Act to place certain restrictions on storage
and sale of Kerosene as used for illuminating 2)nrposes."
Interpretation of terms.
4. I n t he cons t ruc t ion of this A c t t he following words wi thin
inver ted commas shall haA^e t he meanings assigned to t h e m respectively
unless inconsis tent wi th t h e context ( tha t is to say )—
" G o v e r n o r " — T h e Governor wi th the advice of t he Execut ive Council .
" M i n i s t e r " — T h e Colonial Treasurer or other Minis te r hav ing the
depar tmenta l control of the several ma t te r s provided for by
th is Ac t .
" Ordnance S t o r e k e e p e r " — T h e Ordnance Storekeeper or any officer or person appointed for any special du ty unde r this A c t so far as such du ty is concerned or any person having the custody of a public magazine .
" M a g a z i n e " — A n y bui ld ing hu lk or o ther floating vessel pro claimed by the Governor to be ei ther a publ ic or licensed magazine for t he storage of explosives or explosive substances.
" Exp los ive"—Gunpowder nitro-glycerine dynami te l i thofracteur blas t ing powders picric powder gun-cot ton pyrolignoino or any explosive prepara t ion of vegetable fibre fulminate of me rcu ry or of other metals and every o ther substance whe the r similar to those above-ment ioned or not which m a y from t ime to t ime be proclaimed by t h e Governor as hereinafter provided.
" Explosive subs tance"—Pet ro leum kerosene picrate of potash or any new explosive substance which m a y hereafter be m a n u factured colored fires cartr idges or a m m u n i t i o n of which an explosive forms a pa r t fireworks rockets detonators a n d every adapta t ion or prepara t ion of an explosive or an explosive subs tance as above defined.
" I m p o r t e r " — T h e impor te r owner consignee or other person whose n a m e appears in the bil l of lading ship 's manifest or invoice of any explosive or explosive substance on board any vessel.
" Collector of C u s t o m s " — T h e Collector or any o ther officer of Customs.
" Inspec to r of Po l i ce"—The inspector or any other officer of police.
" B o a t " — B o a t barge p u n t or any other k ind of small vessel. " Packages"—Bar re l s m e t a l cases or canisters or wooden boxes
conta in ing such.
" Bui ld ing"—'Any stone br ick or other bui lding of whatever
mater ia ls .
" P r e c i n c t s " — T h e ground or wa te r su r round ing any magazine proclaimed to be i ts precincts .
" Van"—-Any van t r uck waggon dray or other vehicle used e i ther on t h e road or rail .
" P r e m i s e s " — A n y store shop warehouse cellar or other bui lding registered for the storage or keeping of explosives or ex
plosive substances.
" Dealer"—-The seller or purchaser for t rad ing purposes or the manufac tu re r of explosives or explosive substances.
Importation landing and exportation of Explosives.
5. The mas te r or officer in charge of any vessel ar r iv ing in Por t J a c k s o n or any o ther por t wi th in the Colony hav ing any explosive on board besides t he ship 's stores in ship's magazines shall immedia te ly after en te r ing such por t hoist a Pi lot J a c k at the main-mas t head and keep t h e same flying un t i l all the explosives on board shall have been landed according to t h e provisions of th is Act or he shall be liable to
| a penal ty no t exceeding twenty pounds. | (3. |
i G. The mas te r of every vessel a r r iv ing in t he ha rbour of P o r t 1 J a c k s o n shall deliver u p in conformity wi th the provisions of this Ac t all explosives on board such vessel whe ther as cargo or stores before such vessel shall be allowed to pass to the westward of Garden I s land and shall no t afterwards have on board any explosive on pa in of forfeiture of all found on board and the packages in which t he same m a y be conta ined and shall also be liable to a pena l ty not exceeding fifty pounds The provisions a n d regula t ions contained in or which m a y be m a d e unde r th is A c t so far as t hey affect t he impor ta t ion l and ing storage and removal into or ou t of any magaz ine of explosives shall be held to include and refer to car tr idges.
7. Should any explosive or explosive substance exceeding twelve pounds weight be impor ted in any vessel ar r iv ing in P o r t Jackson or any other por t wi th in t he Colony whe ther by itself or packed wi th any o ther merchandize and t h e package containing t he same not be ing marked so as to show t h a t an explosive or explosive substance is therein contained specifying the same and also shewing t h e quant i ty thereof such explosive or explosive substance together wi th t he package con ta in ing t he same and the said merchandize shall be liable to seizure and confiscation A n d the impor ter of t he same wilfully neglec t ing to repor t the impor ta t ion of such explosive or explosive substance to t he Collector of Customs wi th in forty-eight hour s after t he enter ing of the said vessel shall be liable to a pena l ty not exceeding t en pounds .
8. U p o n t h e display of t he signal directed by section five t he Ordnance Storekeeper shall w i thou t unnecessary delay cause the requis i te licensed boats to proceed to t he said vessel and shall a t once demand and receive from the mas te r thereof all explosives t hen being on board and shall the reupon give to the mas te r a receipt describing the packages conta in ing t h e same as in t he Second Schedule hereto which receipt shall be deemed in law to ma in ta in any lien which t he mas te r or owner of t he vessel m a y have upon the said explosives and car t r idges there in described for freight or o ther lawful charges upon t h e same respectively A n d the Ordnance Storekeeper shall the reupon deposit the said explosives and cartr idges in t he magazine appointed in t h a t behalf A n d every impor ter thereof shall Avithin forty-eight hours after t he arrival of t he said vessel deliver to t he Ordnance Storekeeper a full description of the said explosives and cartr idges showing the
quan t i ty wi th t he m a r k s and number s of t he packages conta in ing t he
same which descript ion t h e Ordnance Storekeeper shall en ter toge ther w i th t he name of such impor te r in a book to be kep t for t h a t purpose
and shall t he reupon give a certificate of such ent ry to t he said impor ter
in t he form contained in t he Second Schedule hereto A n d no person shall be ent i t led to receive any explosive or car t r idges from the magazine unless he shall produce to t he Ordnance Storekeeper such certificate and shall have paid t h e l ighterage from the vessel and the storage and a n y other charges authorized by th is Act .
9. Al l explosives exceeding twelve pounds weight shall be dis charged from the vessel impor t ing t he same between the hours of six in t h e m o r n i n g and four in the afternoon A n d as often as any quan t i ty exceeding twelve pounds weight shall be so removed t h e same shall be t aken d i rec t from t h e vessel to such magazine as shall have been appointed for its recept ion ei ther in Government or o ther boats duly licensed by the Minis ter in t h a t behalf or by such other mode of t ransi t as m a y be directed by the Minis ter b u t a t the expense of the importer of all such explosives or car t r idges who shall pay the charges for l ight erage stated in the Third Schedule hereto to t he Ordnance Storekeeper and any person landing or a t t empt ing to l and any explosive contrary to t h e provisions of th is or the preceding section shall be liable to a pena l ty no t exceeding twenty shill ings for every pound weight so landed.
10. N o explosive t aken from any magazine shall he landed in any pa r t of t he harbour of P o r t J aekson or Newcast le o ther t h a n a t t he wharf or place appointed from t ime to t ime by proclamat ion of the Governor nor at any o ther t ime t h a n between t h e hours of six and n ine o'clock in t h e morn ing under a penal ty in ei ther case not exceeding twen ty shillings for every pound weight .
1 1 . Al l boats employed in the landing or removal of explosives
exceeding fifty pounds weight in t he ha rbour of P o r t J ackson or Newcast le shall be thoroughly covered in or housed over and shall be; sufficiently provided wi th coverings duly authorized by the regula t ions and shall also fly a danger signal to be prescribed by the Minis te r and notified in t he Gazette and any person (whether employed by the Ordnance Storekeeper or otherwise) who shall remove or cause to be removed explosives exceeding fifty pounds weight in any other m a n n e r shall be liable to a pena l ty not exceeding twen ty shillings for every pound weight .
12. N o "explosive or explosive substance (except kerosene) exceeding twelve pounds weight shall be shipped on board any vessel in t he harbours of Po r t Jackson or Newcast le wi thou t a special notifi cat ion thereof to t h e Collector or other pr inc ipa l officer of Customs nor shall t h e same be shipped delivered or conveyed in any boat or van wi thou t a plain and durable b rand or superscr ipt ion on the package conta in ing t h e same showing what explosive or explosive substance is the re in contained A n d if any person shall so ship or deliver or cause to be shipped or delivered any such explosive or explosive substance wi thou t such notification or wi thou t such b rand or superscript ion or if any mas te r of any vessel shall knowingly receive on board or permit to be landed any such explosive or explosive substance wi thout such notification and b rand or superscript ion every such person so offending shall be liable to a penal ty not exceeding fifty pounds .
13 . N o person shall ship or a t t e m p t to ship and no mas te r of
any vessel ly ing in t h e harbour of Po r t J ackson and ou tward bound shall knowing ly or negl igent ly receive or permi t to be received on board any explosive exceedin gfifty pounds before such vessel shall have reached to t he eastward of Garden I s land under a.penalty not exceeding twenty shillings for every pound weight .
14. N o steam-vessel carrying passengers depar t ing from any
por t or p ly ing on any r iver of N e w South Wales shall carry any
explosive ei ther as stores or cargo except such signals and reasonable

| gers or on board which any explosive may be found cont rary to t he provisions of th i s section shall be liable to a penal ty not exceeding fifty pounds nor less t h a n t en pounds Provided always t h a t where there; is no available communica t ion except by s team vessels car ry ing passen gers wi th any por t or place i t shall be lawful to ship any explosive no t exceeding fifty pounds by such steam-vessel on condit ion t h a t i t shall be provided wi th a special compar tmen t or magazine and t h a t such steam- vessel shall also ca r ry a danger flag on enter ing any port or coining near to any o ther place in N e w South Wales for d ischarging cargo. | |
| 15. W h e n any explosive shall be delivered from any magazine in t he harbour of P o r t J a c k s o n for sh ipment t he exporter or owner thereof on receiving t h e pe rmi t for t he same shall give not ice in wr i t ing to t he Ordnance Storekeeper of t he day i t will be required to be placed on board t he vessel by which i t is in tended to be expor ted wi th every documen t required by law for shipping the same and if the vessel be no t ready to receive t he same the said explosive may be lodged temporar i ly in t he magazine a t F o r t Denison the owner or exporter pay ing for the same the weekly s torage and delivery charges |

specified in t h e Fi f th and F o u r t h Schedules hereto bu t t h e Government will no t be held responsible for any short sh ipments made t h r o u g h any omission of t he exporter thereof t o furnish a proper not ice in wr i t ing of such sh ipment or for any incomplete a r rangements for t h e same or for delivery a t o ther t h a n the hours aforesaid of any gunpowder or blast ing powder which may be short shipped A n d such explosive m a y remain a t such t empora ry magazine for one week wa i t ing another vessel after which t he explosive so r ema in ing will
be r e tu rned to t h e publ ic magazine a t t h e cost of the expor ter a t t he ra tes specified in the Thi rd Schedule here to . 16. A n y explosive exported from Por t J ackson and in tended for
storage in any other magazine a t any other por t of N e w South W a l e s provided wi th an approved magazine shall be stored free in the la t t e r for th ree days if in tended for immedia te t ransmission into t he inter ior or if for general issue shall be assessed a t t h e rates per week s tated in the Fif th Schedule here to Provided always t h a t due a n d proper not i fication is given of such transfer from one magazine to ano ther to t h e Ordnance Storekeeper and for the purpose as aforesaid and in t h e absence of such not ice it shall be lawful for t he Ordnance Store
keeper to t rea t such explosive as an original importa t ion. 17. A l l explosives exceeding twelve pounds weight w h e n in
course of removal shall be in barrels closely jo ined and hooped or in copper zinc or t inned cases or canisters enclosed in Avooden boxes or barrels and not conta in ing more t h a n one hundred pounds in A v e i g h t of powder or o ther explosive and so secured t h a t no p a r t of t h e explosive can be scat tered in i ts removal A n d in case any of such packages shall be defectively cons t ruc ted or made con t ra ry to t he provisions of this section or of any regula t ion which may be here after m a d e by t h e Minis ter t he Ordnance Storekeeper m a y if he deem it necessary remove t he conten ts of t he said packages into secure and properly constructed barre ls or boxes and charge and receive from t h e impor ter for such removal no t less t h a n t en shill ings and sixpence per barrel or box so repacked and shall pay to t h e Colonial Treasurer t he difference between t he a m o u n t received by h i m and t h e ac tua l cost of such re -packing and the Ordnance Storekeeper m a y refuse to deliver to t he said impor te r t he explosive so re-packed u n t i l t h e said charge shall be paid Provided ahvays t h a t in case such repacking cannot be done wi thou t clanger t he Ordnance Storekeeper m a y order t h e said explosive so defectively packed to be destroyed.
The removal and carriage of Explosives and Explosive Substances.

such offence be liable to a pena l ty no t exceeding ten pounds and to t he forfeiture of all t he explosives and their packages t hen being in such van Provided t h a t explosives carr ied on t h e Government Rai lways shall no t be so forfeited.
19. Al l explosives conveyed by vans shall be packed in t h e
m a n n e r required by section seventeen and in addit ion there to any kegs of b las t ing or loose powder shall be placed in bags or sacks and so secured t h a t no par t of t he explosive can be scattered in t he removal thereof and no package shall contain more t h a n one hund red pounds weight .
20. Al l applications for t h e delivery of any explosive deposited
in a n y magazine shall be m a d e to t he Ordnance Storekeeper Avho shall deliver t h e same accordingly to t h e holder of t h e certificate thereof or o ther person duly authorized to receive the same and if in tended for delivery in t he City of Sydney or suburbs or a t any por t of t he Colony the same s h a l l be delivered a t t he wharf or place appointed by t h e Governor du r ing the hours provided by th is A c t or any regula t ions made the reunder or if in tended for sh ipment the same shall be delivered to t h e vessel by which the same is in tended to be expor ted between t h e hours of seven in the morn ing and four in the afternoon or if for car r iage by the rai lway the same shall be delivered be tween the hours of seven in t he morn ing and noon on t h e days appointed for t he con veyance of explosives.
2 1 . N o person shall t ake any explosive exceeding one hund red
pounds ne t weight to any rai lway station un t i l he has obtained a certificate for t rans i t thereof from t h e traffic manager t ha t he is prepared to receive i t and any such explosive shall be removed from the stat ion to which it is consigned wi th in twenty-four hours after ar r ival or be l iable to forfeiture A n d any person so offending in any such case shall be liable to a pena l ty n o t exceeding fifty pounds .
22. N o person shall carry any gunpowder exceeding two pounds
in weigh t or o ther explosive in any omnibus coach or o ther publ ic vehicle used for t he carr iage of passengers nor in any l icensed boat any o ther passenger being there in under a pena l ty no t exceeding five pounds .
The storage of Explosives.
23. Explosives shall no t be kep t a t any place except as follows
( tha t is to say)—•
(1.)
Excep t in a magazine ei ther now exis t ing or which m a y here (2.) Or in a pr ivate magazine duly licensed under t h e au thor i ty after be proclaimed by the Governor as a publ ic magazine
and according to t h e provisions of this Ac t for t he s torage of
explosives
(3.) Or on any premises duly registered under t he provisions of
th is A c t
Provided always t h a t th i s section shall no t apply to any person keeping explosives for his own use and not for sale and not exceeding the a m o u n t of twelve pounds weight on t he same premises unless duly registered as aforesaid A n d whenever any explosive shall be kep t in any place other t h a n is above or elsewhere by th is A c t authorized the same may be for thwith seized by the Ordnance Storekeeper Inspec tor of Magazines or Inspec tor of Police and may be declared to be forfeited by any two Jus t i ces A n d the occupier of such place and the owner of t he explosive so unlawfully author iz ing the keeping of t he same as aforesaid shall each be liable to a penal ty no t exceeding twen ty shill ings for every pound weight of explosives so kep t in excess of t h e authorized quant i ty .
24. The Governor m a y by proclamat ion publ ished in t he Gazette
declare and appoin t as a " Pub l i c M a g a z i n e " or as a " Licensed M a g a z i n e " any bui ld ing which shall be certified by t h e Ordnance Storekeeper to be suitable w i th regard to i ts s i tuat ion and ex terna l a n d in t e rna l const ruct ion for t h e safe custody of gunpowder or any other explosives as t h e case m a y be A n d upon any such bui lding being so proclaimed the Minister: m a y issue a " spec i a l l icense" as hereinafter provided to t h e owner or o ther person in tended to have the charge of t h e said magazine provided tha t such owner or person shall be approved by t h e Min i s te r as being duly qualified A n d which license shall be valid only for t he person .named in i t A n d in t he event of any wilful neglect of any provision of th is A c t or of any regula t ion made under i ts a i i thori ty by t h e person so being licensed all or any p a r t of t he explosives t h e n in his magazine a t t h e t ime t h e offence was commit ted shall be liable to be declared forfeited by any two Jus t i ces in P e t t y Sessions and the owner or occupier, (being such licensee) shall also be liable to a penal ty no t exceeding ten pounds for every day du r ing which such negl igence may cont inue and the said " special l i c e n s e " may also be forfeited.
25. A license m a y be gran ted to any person for a p r iva te
magazine (in th i s A c t t e rmed a " L i c e n s e d M a g a z i n e " ) subject to theseveral provisions of th i s A c t and of any regula t ions which m a y be
m a d e thereunder .
26. A n " o r d i n a r y l i c e n s e " may be gran ted to any dealer in explosives subject to all t h e provisions made in t he case of " registered
p r e m i s e s " and for t h e sale of explosives by dealers. 27. A " special l i cense" may be granted to any person who shall be t he owner or occupant of any bui ld ing or premises (not being wi th in t he City of Sydney or i ts suburbs) which may have been approved by t h e Minis te r subject to all t he provisions m a d e in t he case of " regis tered premises " and which bui lding or premises may be capable of s tor ing wi th safety la rger quant i t ies of explosives t h a n arc author ized to be k e p t by a dealer unde r an " ordinary l icense."
The keeping and sale of Explosives.
28. I t shal l no t be lawful for any person to become a dealer in explosives after t h e passing of th is Ac t un t i l he shall have obtained from the Min i s te r ei ther a n " o r d i n a r y " or a " s p e c i a l " l icense as herein provided or he shall be l iable to a pena l ty not exceeding one hundred
pounds Provided always t h a t such license w h e n g ran ted shall be duly publ ished in t h e Gazette and shall be in force for twelve mon ths . 29. N o dealer in explosives shall have or keep a t any one t ime in any one store or place more t h a n two hundred-weigh t of explosives except as hereinaf ter provided and no person not be ing such dealer more t h a n twenty-five pounds weight of explosives in any house store warehouse shop cellar yard or wharf or o ther bu i ld ing premises or place occupied by t h e same person and if any explosive be kep t cont ra ry hereto t he owner or person in possession of t he same shall forfeit all such explosives and the packages in which the same shal l be kep t and shall also be liable to a pena l ty no t exceeding t en shill ings for every pound weight of t he same beyond such authorized quan t i ty .
30. Eve ry dealer in explosives shall cause to be pa in ted in legible charac ters on some conspicuous p a r t of t he shop or warehouse conta in ing the same the words " Gunpowder sold h e r e " or he shal l be l iable to a pena l ty of five pounds for every day of such omission.

shall be deposited in any magazine shall sell or transfer t h e whole or any p a r t of t h e same to any other person such sale or transfer shal l be
immedia te ly
immedia te ly repor ted in wr i t ing to the Ordnance Storekeeper and a certificate of such sale or transfer toge ther wi th any other documents necessary for c la iming transfer and delivery of such explosive from such impor ter or owner shall also be produced to t he Ordnance Store keeper in order t h a t t he same m a y be duly registered otherwise t h e Ordnance Storekeeper m a y refuse to deliver u p t he said explosive to any other t han t h e recipient of t he original certificate.
Magazines and their Management.
32. The Governor may from t ime to t ime by Proc lamat ion declare and appoint t he space or dis tance sur rounding any publ ic magazine for t h e s torage of explosives to be i ts precincts wi th in which it shall no t be laAvful for a n y person to come wi thout the au thor i ty of t h e Minis te r or Ordnance Storekeeper A n d any person en te r ing such precincts wi thou t such au thor i ty and refusing to wi thdraw after being directed so to do b y the Ordnance Storekeeper or o ther person unde r his au thor i ty m a y b e ei ther forcibly removed or t aken in to custody b y h i m for t he purpose of be ing b rough t before the nearest Court of P e t t y Sessions and shall be liable to a pena l ty not exceeding twen ty pounds .
33 . A n y person b r ing ing fire or ma tches for t h e purpose of igni t ion or smoking wi th in t he precincts of any magaz ine m a y be forth with t aken into custody by the Ordnance Storekeeper or police constable or any o ther person in order to his being dealt wi th as is in the last section provided and such person so offending shall be liable to a penal ty

35. Every Inspec tor of Magazines shall have au thor i ty to enter and inspect a t any t ime any publ ic or licensed magazine and a t any t i m e be tween the hours of n ine a n d four in t he day any premises regis tered unde r this A c t for t h e purpose of examin ing t h e s ta te and condit ion thereof and of t he packages of explosives stored therein and such Inspec tor is he reby author ized thereupon a t once to give to t he Ordnance Storekeeper or officer in charge of any publ ic magazine; or to t he licensee or person in charge of any licensed magazine or premises any orders or directions respect ing t he custody and m a n a g e m e n t of such magazine or premises a n d the explosives there in stored or any o ther

30. Every owner of a " L i c e n s e d M a g a z i n e " m a y wi th t he
sanct ion of t he Minis te r m a k e and may afterwards a l ter or expunge any special rules for the control of t h e persons m a n a g i n g or employed in and abou t such magazine (any such rule not be ing inconsis tent wi th t he provisions of th is A c t or any regulat ions made by t h e Governor unde r i ts au thor i ty) w i th a view to secure the observance of this Ac t the re in and t h e safety a n d proper discipline of t he said persons.
37 . Every owner or licensee of any licensed magazine shall
forward wi th in one week after t he end of every m o n t h to the Ordnance
Storekeeper a detailed s t a t emen t of all explosives deposited in his
magazine
magazine or delivered out by h i m and of all moneys received by h i m on account of s torage or otherwise du r ing t h e m o n t h preceding under
a pena l ty no t exceeding t e n pounds for every default. 38 . N o explosive exceeding twenty-five pounds shall be stored in any magaz ine or in any registered premises in t he same compar t m e n t w i th any other explosive or wi th in t h e distance of t en feet there from a n d any person s tor ing any explosive cont ra ry to t h e provisions of th i s section shall be liable to a pena l ty of t w e n t y shil l ings for every pound weight so stored and except in the case of a PubHc Magaz ine all such explosives m a y be forfeited and t h e license g ran ted to t he person so offending m a y also be forfeited.
Registration of Premises.
39. Premises where in any explosive exceeding twenty-five
pounds weigh t is kep t shall be registered A n d any person desirous of reg is te r ing any premises e i ther for t he sale or keep ing of any explosive shall regis ter his n a m e and cal l ing wi th t he Ordnance Storekeeper and shall the rewi th deliver a correct descript ion of t he said premises and the s t reet a n d t o w n or o ther locali ty where t he same are s i tua ted and an Inspec tor of Magaz ines or such other officer as m a y be appointed by the Governmen t in t h a t behalf shall t he reupon inspect t h e said premises a n d if approved by the Minis te r as be ing suitable and in compliance wi th th i s A c t a n d any regula t ions established the reunder t h e Minis ter m a y immedia te ly authorize t he Ordnance Storekeeper to regis ter in a book to be k e p t by h i m for t h a t purpose t h e n a m e and calling of such person a n d t h e specified premises and to give h i m a certificate thereof and such person shall t h e r e u p o n be duly authorized to keep gunpowder upon t h e premises there in specified (and in this Ac t referred to as " registered premises") du r ing the period specified in his license Provided always
t h a t such regis t ra t ion and certificate shall be valid only for t h e person and specific premises registered.
40. The following general rules shall be observed wi th respect to " regis tered premises " :—
(1.) I f t h e explosive is kep t in a substant ia l ly const ructed bui ld ing exclusively appropr ia ted for t h e purpose a n d detached from a dwell ing-house or in a fire-proof safe outside a dwell ing-house and detached therefrom and at a safe dis tance from any h ighway street publ ic thoroughfare or publ ic
place five hundred pounds weigh t m a y be kep t in t he same
registered premises or if on and for t h e use of a mine quar ryrai lway or publ ic work in course of cons t ruc t ion four thousand pounds weigh t if kep t in a detached bu i ld ing exclusively
appropr ia ted for t h e purpose . (2.) I f it is kep t inside a dwell ing-place or in any bui ld ing o ther t h a n as last aforesaid t h e quan t i ty shall no t exceed th ree
h u n d r e d pounds weight .
(3.) I f i t is deposited in a fire-proof safe wi th in such house or bui ld ing an a m o u n t not exceeding four hundred pounds
weight
may be kep t .
(4.) Al l gunpowder and blas t ing powder shall be secured in packages as specified in section seventeen.
(5.) N o person shall be allowed to smoke or b r ing ma tches for the purpose of igni t ion in to t he said registered premises.
(6.) N o person u n d e r t he age of s ix teen years shall be employed in t he said regis tered premises unless in t h e presence and
under t h e supervision of some adul t person.
(7.) N o explosive shall be sold or given to any child apparen t ly
u n d e r t h e age of th i r teen years .
(8.)
(8.) Al l gunpowder or o ther explosive exceeding one pound in weight w h e n either exposed for sale or sold shall be in a sub stant ia l case canister or other receptacle made and closed so as to p reven t t he gunpowder or other explosive from escaping and the outs ide covering or wrapper shall have t h e word " Gunpowder" wr i t ten in large le t ters or pr in ted thereon.
A n d if any breach of th is section is commit ted b y t h e person so regis tered he shall be l iable to a pena l ty not exceeding fifty pounds and all the explosives t h e n being in such registered premises m a y be forfeited.
Regulations.
4 1 . The Governor shall a t all t imes have and exercise the

(I .) l i e m a y from t ime to t ime m a k e and publ i sh regula t ions not be ing inconsis tent w i th th i s A c t for t he m a n a g e m e n t and control of all magazines now or hereafter proclaimed and especially for t he quant i t ies of explosives which m a y be stored in every such magazine .
(2.) F o r t h e impor ta t ion storage custody removal and carriage of explosives e i ther by land or water .
(3.) F o r declaring w h a t quan t i ty of explosives or explosive sub stances m a y be removed or carried ei ther to or from such magazines .
(4.) F o r prescr ibing t h e size and description of boats to be used for t h e t ranspor t
of t he same by water
and t h e
m a n n e r
in
which such boats shall be cons t ruc ted and fitted u p .
(5.) F o r prescr ib ing precaut ions to be used in conveying any
explosive.
(0.) F o r appoin t ing t he places respectively where the same may be
delivered ei ther from on board ship in order to be stored in amagaz ine or from a magazine in order to be conveyed elsewhere.
( 7 . ) F o r g ran t ing licenses for carrying the same to any owners of boats or vans and prescr ibing rules for the i r guidance in either case. (8.) F o r declar ing w h a t flag or other danger signal shall be displayed by boats or vans when conveying explosives.
(9.) F o r providing for t h e s torage and removal of any b las t ing
powder or other explosive for publ ic works or min ing purposes.
(10.) F o r prescr ibing the duties of Inspectors of Magazines and for
f raming any other regula t ion for carrying in to effect t he
in ten t ions and objects of this Act .(11.) For procla iming any other por t to be subject to t h e regula t ions a n d provisions of th is Act .
Provided t h a t all such regulat ions are the reupon published in t h e Gazette And tha t copies of all regula t ions so made shall wi thou t unnecessary delay be laid before Pa r l i amen t if a t t he t ime in Session otherwise

42. 43 . Eve ry person storing explosives in any public or licensed magazine or t ak ing out an " ordinary license " or " special license " or a l icense for a " m a g a z i n e " or " registered premises" u n d e r t h e pro visions of th is A c t shall pay for t h e same respectively t h e fees specified in t he Sixth Schedule hereto.
Rent
' Rent and Charges for the Storage and Delivery of Explosives, 44. The store r en t and charges due upon any explosive de posited in any publ ic magazine shall be paid every six m o n t h s unless sooner delivered and if such r e n t and charges be not so paid to t h e Ordnance Storekeeper he may cause a notice to be publ i shed in t h e Government Gazette r equ i r ing t he impor te r or owner to pay the a m o u n t
due a n d in t ima t ing t h a t if no t pa id wi th in one m o n t h t h e said explosive will be forfeited A n d if no t t hen paid t he Ordnance Store keeper m a y cause t he said explosive to be sold by publ ic auct ion on the day fixed by the said not ice and the ne t proceeds of such sale shall in t h e first instance be applied to t he p a y m e n t of all r en t and charges due the reon and the ba lance if any shall be paid to t he holder of t he certificate of deposit of such explosive or such balance m a y be paid to t he Colonial Treasurer who shall place t he same to t he credit of t h e
Consolidated Revenue F u n d . 45 . The storage r e n t for any explosive deposited in any publ ic magazine as aforesaid shall be paid by t h e impor te r or holder of t he certificate thereof according to the rates contained in the Fif th Schedule here to and such impor ter or holder shall be held liable for the paymen t of s torage r en t and all o ther expenses the reupon un t i l t he transfer in t he proper ty of such explosive has been duly reported and registered as here in provided.
46 . A n y person apply ing for a pe rmi t for delivery of any explosive shall a t t he t ime of such appl icat ion pay to t he
Ordnance
Storekeeper t he ra tes contained in t h e F o u r t h Schedule here to the Ordnance Storekeeper charg ing for l and and water t r anspor t combined or separately as the case m a y be . 47 . Al l moneys received by the Ordnance Storekeeper for t he storage or del ivery of explosives or for other charges in respect thereof and all penal t ies recovered and the proceeds of sale of all explosives or explosive substances adjudged to be forfeited shall be paid to t h e Colonial Treasurer and be accounted for as pa r t of the Consolidated Revenue F u n d of the Colony.
Miscellaneous Sections. 48. Nothing in this Act contained shall be deemed or held
to apply—• (1.) To any explosive or explosive substance the proper ty of H e r Majesty on board any of H e r Majesty 's sh ips—
(2.) N o r to t h e keep ing of explosives or explosive substances in any magazine belonging to H e r Majesty or to the carr iage thereof to and from any magaz ine unde r a special order of t h e Min is te r or w h e n u n d e r the control and managemen t of any
officer of H e r Majesty 's A r m y N a v y Ordnance or o ther duly author ized pe r son— (3.) N o r to any gunpowder rockets or other explosive or explo sive substance on board any vessel in pursuance of t he provisions of the " M e r c h a n t Shipping Act 1 8 5 4 " and the Acts amend ing t h e same or any order or regula t ion m a d e under any of those Acts Provided t h a t the conveyance and keep ing thereof on board the vessel or elsewhere while the vessel is in harbour shall be subject to the regula t ions made or to be
m a d e under th is Ac t . (4.) N o r to any explosives or explosive substances supplied to or used by H e r Maies tv ' s Colonial and Volunteer Forces .
49. The Governor may from t ime to t ime by proclamat ion
prohib i t ei ther absolutely or for a s ta ted period the manufac ture impor ta t ion from places beyond the Colony storage conveyance or sale of any explosive or explosive substance which is of so dangerous a character t h a t in the j u d g m e n t of t he Governor it is expedient for t he public safety

50. The Collector and other officers of Customs shall have and
exercise the same powers w i th respect to any explosive or explosive substance t he impor ta t ion of which may have been so prohibi ted by t h e Governor and which m a y be found on board any vessel after ar r ival in any por t of t he Colony or which may have been landed from such vessel and also wi th respect to t he vessel so impor t ing or landing the same t h a t t he said Collector and o ther officers of Customs may have and exercise under t h e laws a t t he t ime i n force Avith respect to any art icle prohibi ted to be impor ted by any laAvs re la t ing to t h e Customs and Avith respect to t h e vessel impor t ing t he same and the said laws respectively shall be construed in all Courts of Jus t i ce to apply to t h e provisions of this section accordingly Provided always t h a t t he said explosive or explosive substance after any such seizure shall be t aken charge of t he r eupon by the Ordnance Storekeeper for deposit in a publ ic magaz ine .
5 1 . The Ordnance Storekeeper and all persons employed under
h i m in charge of explosives shall be SAVorn in as special constables.
52 . I f a n y person throAV cast or fire any fireAvorks in or into
any higliAA'ay s t ree t thoroughfare or publ ic place he shal l be liable to
a pena l ty no t exceeding five pounds .
Explosive Substances.
53 . The Governor m a y from t ime to t ime by Proc lamat ion
publ ished in the Gazette exempt from the operation of any sections of
| th i s A c t to be specified in such Proclamat ion any chemical or |
mechanica l preparat ions which are the reby or may hereafter be declared to be " explosive substances " t ha t shall be in general use a n d which in t h e opinion of t h e Governor may safely be consigned or stored in la rger quant i t ies t h a n is by this A c t authorized and t h e Governor may the reupon m a k e special regula t ions for t h e safe keeping removal or carr iage of any explosive substances so exempted.
54. N o t h i n g in th is A c t shall render liable to any pena l ty or
forfeiture t h e Ordnance Storekeeper oAvncr or mas te r of any vessel or boa t or dealer or t h e person hav ing charge of any explosive or explosive substance for any act done in b reach of any section of th i s Ac t if he prove t h a t by reason of stress of Aveather inevitable accident or o the r emergency t h e doing of such A c t Avas unde r t h e c i rcumstances impera t ive .
Recovery of Penalties and Forfeitures.
55. W h e r e any offence under this Ac t for which the OAvner of
any explosive or explosive substance occupier OAvner or licensee of any magazine store or registered premises or any carrier by land or water
D is is liable to a penalty or forfeiture has in fact been committed by some
other person the latter shall be liable to a penalty not exceeding fifty pounds And where any such owner or licensee or occupier or carrier
is charged with an offence which has in fact been committed by someother person then such owner licensee occupier or carrier as the case may be shall be exempt from any penalty or forfeiture upon proving that he had supplied proper means and issued proper orders for the observance and used due diligence to enforce the observance of this Act and that the offence in question was actually committed by some other person without his connivance and (if the actual offender be alive) that he has taken all practicable means in his power to prosecute such offender to conviction.
56. For any breach of this Ac t where no penalty is specifically provided for the person offending shall be liable to a penalty not
exceeding ten pounds And out of any penalty or forfeiture imposed
under the authority of this A c t the convicting Justices shall award a moiety of the penalty to the person on whose information the prose cution in the case was instituted Provided nevertheless that theGovernor may remit such moiety of either the penalty or the forfeiture
as shall have been so awarded as aforesaid Provided always that the full amount of such penalty or of the proceeds of such forfeiture as the case may be shall always be paid in the first instance to the
Colonial Treasurer to the credit of the Consolidated Revenue Fund of
the Colony.
57. Any penalty or forfeiture for any offence against this A c t may be enforced and recovered upon summary conviction before any
two Justices in manner provided by the Acts eleven and twelve Victoriachapter forty-three as adopted by the A c t of the Governor and Legis
lative Council fourteen Victoria number forty-three and any Acts
amending the same.
Legal Proceedings.
58. A l l complaints or other legal proceedings may be laid and taken by the Ordnance Storekeeper or other officer appointed by the
Governor in that behalf against any person for non-compliance with or
any breach of this Ac t or any regulations made under its authority.
59. Any person feeling himself aggrieved by any conviction or penalty or charge imposed under the authority of this A c t where the penalty or sum exceeds five pounds may appeal against the same to
the next Court of Quarter Sessions holden in the district where the subject matter thereof arose unless such Quarter Sessions shall be held within fourteen days from the date of such conviction or judgment and in that case to the Court of Quarter Sessions then next following
And such Court shall have power to hear and determine the matter in a summary way and shall have and exercise all other powers vested in them by the third section of the Ac t fifth William the Fourth number twenty-two and the decision of such Court shall be final and conclusive in respect to the subject matter of such appeal Provided
always that the person so appealing shall have given written notice seven days at the least before the hearing of such appeal of his inten
tion to appeal and stating the grounds thereof to any one of the con victing Justices and to the Ordnance Storekeeper or other officer duly appointed by the Governor in that behalf and who prosecuted the matter before the Justices in Petty Sessions And provided also that such person (in ease a penalty shall have been awarded against him) shall pay into the hands of the convicting Justices the full amount thereof together
with the costs awarded within one week next after conviction and shall within the same period enter into a bond with two sureties approved
by
by such Jus t ices condit ioned to prosecute such appeal wi th effect and to abide t he event of such appeal and to pay t h e full a m o u n t of all such costs as may on such appeal be awarded against h im.
60. I t shall be lawful for any Jus t i ce of t he Peace on reasonable cause assigned upon oath by any person to issue a war r an t unde r his h a n d addressed to a police officer or constable author iz ing h i m to search in t he day-t ime any house warehouse store shop cellar yard wharf or other bui ld ing or place or any van boat or vessel in which any explosive is suspected to be k e p t or carried contrary to the provisions of th is Ac t and any explosive found to be so kep t or carried and also t he packages or other receptacles conta in ing t h e same shall be immedia te ly seized by such officer or constable who shall forthwith repor t such seizure to t h e Ordnance Storekeeper if wi th in reach and if no t pract icable to communica t e w i t h h im then the police officer o r constable shall report such seizure to his superior officer A n d if such police officer or constable shall be authorized by the Ordnance Storekeeper or by any superior police officer (as the case m a y be) to remove the said explosive he shall the reupon be empowered to remove wi th all due precaut ion such explosive and t h e packages or other receptacles in which i t may be contained to some place of safety and in case of any such explosive so seized being in any van or boat or vessel such officer or constable may use for t h e purpose of removal dur ing the t ime necessary after such seizure such van boat or vessel wi th the oars sails t ack l ing horses oxen and harness yokes and chains belonging to ei ther of t h e m respectively and m a y detain the same together wi th such explosive and the packages or other receptacles in which i t m a y be contained un t i l it shall be adjudged by any two Jus t ices in P e t t y Sessions whe ther the same shall be forfeited or otherwise and such officer or constable shall no t be liable to any suit for such detent ion or for any loss or damage which may happen to t he said explosive or packages other t h a n for his own wilful neglect P ro vided always t h a t if such removal shall be a t tended wi th any r isk and t h e said police officer or constable is duly authorized as last aforesaid in t h a t behalf t he said explosive and packages may be forthwith destroyed.
6 1 . N o order nor any other proceeding m a t t e r or t h ing done
or t ransac ted in relat ion to the execut ion of th i s Act shall be A'acated quashed or set aside for want of form nor be removable by certiorari or otherwise into t h e Supreme Court .
