WH E R E A S thereof t h a t no Gunpowder shal l be landed from t h e Gove rnmen t
by t h e A c t of Counci l five Vic tor ia n u m b e r eleven
i t is amongs t o ther t h ings enac ted in t he four th section
Magaz ine in any p a r t of t h e H a r b o u r of P o r t J ackson o ther t h a n

a t t h e Queen ' s W h a r f or a t any t i m e other t h a n be tween the hour s of six and t e n in t h e m o r n i n g which said enac tmen t was by the A c t of Counci l s ixteen Victor ia n u m b e r forty-seven applied to t he

Gunpowder s tored in t h e Colonial Magaz ine a t Goat I s l a n d A n d
whereas t h e whar f formerly called t h e Queen ' s W h a r f has now
become p a r t of t h e Circular Quay and i t is n o t expedient t h a t G u n ­
powder should be pe rmi t t ed to be landed a t t h e said quay Be it
therefore enac ted by H i s Excel lency t h e Governor of N e w Sou th
Wales w i t h t h e advice and consent of t he Legislat ive Counci l thereof
as fo l lows:—

The four th section of t h e said first reci ted Ac t shal l be and is he reby repealed and in lieu thereof i t is enacted t h a t subject to

t h e

provisoes in t h a t Ac t conta ined no Gunpowder shal l be landed from
any Gunpowder Magaz ine in any p a r t of t he H a r b o u r of Po r t J ackson
other t h a n at the Po in t near Dawes ' Ba t t e ry no r at any t ime other

t h a n be tween t h e hou r s of six a n d t e n in t he m o r n i n g and any person who shall l and or a t t emp t to l and any Gunpowder cont rary to t h e pro­ visions hereof shal l forfeit and pay t h e s u m of two shill ings for every pound of Gunpowder so landed or a t t empted to be landed.
