I, the Minister for Planning, make the following local environmental plan under the

1      Name of plan

This plan is Gundagai Local Environmental Plan 1997 (Amendment

No 2).

2      Aim of plan

The aim of this plan is to amend the requirement for consent for certain development in Gundagai.

3      Land to which plan applies

This plan applies to all land within the local government area of

Gundagai.

4 Amendment of Gundagai Local Environmental Plan 1997

Gundagai Local Environmental Plan 1997 is amended as set out in

Schedule 1.

(Clause 4)

[1]      Clause 2 Aims of plan

Omit clause 2 (c) and (d). Insert instead:

(c)

to require development consent for any development other than extensive agriculture or home occupations.

[2]      Clause 5 Definitions

Omit the definition of designated development from clause 5 (1).

Insert instead in alphabetical order:

extensive agriculture has the same meaning as it has in the standard instrument prescribed by the Standard Instrument (Local Environmental Plans) Order 2006.

home occupation has the same meaning as it has in the standard instrument prescribed by the Standard Instrument (Local Environmental Plans) Order 2006.

[3]      Clauses 7 and 8

Omit the clauses. Insert instead:

7      What development needs consent?

(1)

Except as provided by subclause (2), development may be carried out only with development consent on land to which this plan applies.

(2)

Development for the purposes of extensive agriculture or home

occupations may be carried out without consent.

[4]      Clause 10

Insert after clause 9:

Repeal of plan

This plan is repealed on the second anniversary of the day on which Gundagai Local Environmental Plan 1997 (Amendment No 2) commenced.
