Growth Centres (Development Corporations) Act 1974

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 5 of the Growth Centres (Development Corporations) Act 1974, make the following Order.

Explanatory note
The objects of this Order are:

(a)	to change the name of the Sydney Metropolitan Development Authority to the UrbanGrowth NSW Development Corporation, and
(b)	to change the nature of governance of that development corporation from board governance to chief executive governance, and
(c)	to provide for references to the Sydney Metropolitan Development Authority to be construed as references to UrbanGrowth NSW Development Corporation.

This Order is made under section 5 (1) (c) and (g) (i) and (4) of the Growth Centres

(Development Corporations) Act 1974.

1 Name of Order

This Order is the Growth Centres (Development Corporations) Amendment (UrbanGrowth NSW Development Corporation) Order 2012.

2      Commencement

This Order commences on 1 January 2013 and is required to be published on the NSW legislation website.

3 Amendment of Growth Centres (Development Corporations) Act 1974 No 49

(1) Schedule 1 Growth centres and development corporations

Omit “Sydney Metropolitan Development Authority” from Column 1.

Insert instead “UrbanGrowth NSW Development Corporation”.

(2)	Schedule 1
Omit “Board” from Column 3 of the matter relating to the Sydney Metropolitan Development Authority.
Insert instead “Chief executive”.

4      Construction of references to Sydney Metropolitan Development Authority

(1)	A reference in any Act, in any instrument made under an Act or in a document of any kind to the Sydney Metropolitan Development Authority is to be construed as a reference to the UrbanGrowth NSW Development Corporation.
(2)	In this clause: reference includes a reference that (whether by or under the Growth Centres (Development Corporations) Act 1974 or any other Act) is

required to be read or construed as a reference to the Sydney
Metropolitan Development Authority.

Note. Clause 13 (5) of Schedule 6 to the Growth Centres (Development Corporations) Act 1974 provides that a reference in any Act, in any instrument made under an Act or in a document of any kind to the Redfern–Waterloo Authority is to be construed as a reference to the Sydney Metropolitan Development Authority. As well as providing that a reference to the Sydney Metropolitan Development Authority is to be construed as a reference to the UrbanGrowth NSW Development Corporation, this clause has the effect that a reference to the Redfern–Waterloo Authority is to be construed as a reference to the UrbanGrowth NSW Development Corporation.
