  1. An extension of time is necessary to enable this application for special leave to appeal to proceed. There is no reason to doubt that the decision of the Court of Appeal of the Supreme Court of South Australia was correct. An appeal to this Court would have no prospect of success. The application for special leave should be refused. That being so, it would be futile to grant the extension of time required to enable the application for special leave to proceed.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
