His Excellency the Governor, with the advice of the Executive Council, has approved the following Rule made by the Greyhound Racing Authority (NSW) under the Greyhound Racing Authority Act 1985,

Explanatory note
The object of this rule to amend the Rules of the Greyhound Racing Control
Board 1994 as follows:to allow stud managers (being persons who have the care, control, custody or supervision of greyhounds registered as sires) with the appropriate accreditation to perform artificial insemination in relation to greyhounds using fresh semen.
to allow approved veterinary surgeons (being veterinary surgeons who
hold a current Certificate of Approval issued by the Greyhound Racing Authority) to perform artificial insemination in relation to greyhounds using frozen semen.
to adopt certain procedures and requirements set out in Regulation 7 ("Recording procedure for artificial insemination with frozen semen”) of the Regulations to Govern the Admission of Greyhounds Published in Gazette No 165 of 27 November 1998, page 9026 Page 1

(Artificial Insemination) Rule 1998.
2 Amendment of Rules of the Greyhound Racing Control Board 1994
The Rules of the Greyhound Racing Control Board 1994 are amended as set out in Schedule 1.

[1] Rule 109 Definitions
Insert in alphabetical order:
frozen semen means semen that is, or has been, frozen
within the meaning of the ANZGA Regulations
ANZGA Regulations means the Regulations to Govern
the Admission of Greyhounds into the Australian and
N e w Zealand Greyhound Stud Book made by the
Australian and New Zealand Greyhound Association.
and in force as at the commencement of the Greyhound
Racing Control Board Amendment (Artificial
Insemination) Rule 1998.
[2] Rule 116 Conditions of stud registration
Omit rule 116 (1) (a). Insert instead:
(a) a bitch must not be impregnated by artificial means using chilled semen (not being frozen semen). (a1) a bitch must not be impregnated by artificial means using fresh semen unless:
(i) the drawing of the semen from the sire and the impregnation of the bitch are performed by :
(A) a veterinary surgeon, or
(B) a qualified person. in accordance with such procedures as the
Authority may determine. and(ii) the drawing and impregnation are carried (A) with the consent in writing of the
owner of the sire and the owner of the
bitch, and
(B) at the premises occupied by the person who performs the drawing and impregnation, or such other premises as the Authority may determine, and

Amendments Schedule 1 (iii) the complete ejaculation of the sire is used in each impregnation of a bitch, and
(iv) the person who performs the drawing and impregnation signs, immediately after the completion of those procedures, a certificate for notification of service in the form approved by the Authority,

Insert after rule 116 ( 1 ) (d):
(e)
a bitch must not be impregnated by artificial means using frozen semen unless:
( i )
the impregnation of the bitch is performed by an approved veterinary surgeon. and
( i i )
the procedures and requirements set out in Regulation 7 of the ANZGA Regulations (to the extent that they do not conflict with these Rules), and such other procedures as the Authority may determine, are complied with. and
( i i i )
the owner of the frozen semen consents to its use in the impregnation, and
(iv) the impregnation with the frozen semen is carried out:
(A) with the consent in writing of t he owner of the bitch, and
( B ) at the premises occupied by t he approved veterinary surgeon or such other premises as the Authority may determine.

(f)
if a sire fails to impregnate at least 50% of the bitches served by the sire by artificial means using frozen semen (and in this regard the Authority may if it wishes rely solely on the whelping or other reports received by it), the Authority may cancel the registration of that sire and take such other action under these Rules as the Authority

Rule 116 (4) and (5) Insert after rule 116 (3):

For the purposes of subrule (1) (a1), a qualified person means a stud manager who holds a current Certificate of Recognition issued by the Authority.

For the purposes of subrule (1) (e), an approved veterinary surgeon means a veterinary surgeon who holds a current Certificate of Approval issued by the Authority.

(1) The definitions in the ANZGA Regulations apply in
relation to this rule.

(2) In this rule. a reference to an authorised form is a
reference to a form authorised by the Authority.Forms to be lodged for the purposes of ANZGA Regulations

Each of the following persons must complete the form specified in relation to that person and lodge i t with the Authority within the time (if any) specified for the lodgment of that form:
owner of a facility and who seeks approval of the A registered veterinarian who is the owner or part facility as a centre for the collection. storage or insemination of semen under the Authority's Frozen Semen Insemination program in accordance with Regulations 7.5 and 7.6 of the ANZGA Regulations must lodge authorised form “FSI-1”. A registered veterinarian who seeks approval as an inseminator in accordance with Regulation 7.5 of
the ANZGA Regulations must lodge authorised form “FSI-2”.
A registered veterinarian who seeks approval to collect and store semen in accordance wit h Regulation 7.5 of the ANZGA Regulations must lodge authorised form “FSI-3”. The owner or lessee of a stud sire that is registered with the Authority who seeks to register the stud sire as a sire under the Authority's Frozen Semen Insemination program in accordance with Regulations 7.1 and 7.3 of the ANZGA Regulations must lodge authorised form "A". The owner or lessee of a stud sire that is registered with a relevant authority in a Territory or State other than New South Wales and who seeks to register the stud sire as a sire under the Authority's Frozen Semen Insemination program in accordance with Regulations 7.1 and 7.3 of the ANZGA Regulations with must lodge authorised form "A".

Schedule 1 Amendments
The owner or lessee of a stud sire that is registered with a relevant authority in a country other than Australia who seeks to register the stud sire as a sire under the Authority's Frozen Semen Insemination program in accordance with Regulations 7.2 and 7.3 of the ANZGA Regulations must lodge authorised form “A”.
For the purposes of notification under Regulation 7.4 (c) of the ANZGA Regulations, a registered veterinarian who collects semen from a stud sire under the Authority's Frozen Semen Insemination program must lodge authorised form “FSI-4”
within 14 days of the collection. For the purposes of notification under Regulation 7.7 (d) of the ANZGA Regulations an agent or technician of a centre that receives frozen semen, or from which frozen semen is transported. must lodge authorised form “ F S I - 5 ” within 14 days of receiving or transporting the semen.
For the purposes of notification of service under Regulation 7.7 (a) of the ANZGA Regulations. an inseminator who administers a service of a greyhound bitch by the artificial insemination of frozen semen must lodge authorised form "C"
within 14 days of the service. For the purposes of notification under Regulation 7.6 ( e ) of the ANZGA Regulations a person who declares himself or herself to be owner of frozen
semen of a greyhound drawn for the purpose of freezing under the Authority’s Frozen Semen Insemination program must lodge authorised form “FSI-9” within 14 days of the semen being drawn.
For the purposes of notification under Regulation 7.6 ( e ) of the ANZGA Regulations, an owner of frozen semen who transfers ownership of the frozen semen to mother person must lodge authorised form “FSI-10” within 14 days of the transfer.

(4) Each of the following persons must complete the form specified in relation to that person and lodge it with the Authority within the time (if any) specified for the lodgment of that form: An agent or technician of a centre that acquires frozen semen from another person or centre must lodge authorised form “"FSI-6” within 14 days of the acquisition.
A person who acquires frozen semen from another person or centre must lodge authorised form “FSI-7” within 14 days of the acquisition.
The owner of a stud sire who intends to have semen drawn from the stud sire for use under the Authority's Frozen Semen Insemination program must. before the semen is drawn, lodge authorised
form “FSI-8”.

Late lodgment
(5 )
The Authority may refuse to accept any form lodged after the specified time limit ( i f any) and may impose additional fees or other penalties as it thinks f i t for late
lodgment.
