  1. The applicant seeks special leave to appeal against orders of the Court of Appeal of the Supreme Court of New South Wales (Giles and Campbell JJA and Handley AJA).

  2. The Court of Appeal allowed an appeal against the decision of a Deputy President of the Workers Compensation Commission to revoke the decision of an Arbitrator of the Commission that had dismissed the applicant's claim for workers compensation.

  3. The Court of Appeal's decision turned on the particular facts and circumstances of the case.  No point of general principle would fall for consideration if special leave to appeal were to be granted.

  4. No reason is shown to doubt the correctness of the conclusions reached by the Court of Appeal.

  5. Pursuant to r 41.11.1 of the High Court Rules 2004 we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
