Part 1—Preliminary

1  Name

This instrument is the Greenhouse and Energy Minimum Standards (Refrigerated Cabinets Revocation) Instrument 2020.

2  Commencement

This instrument commences and comes into force on the day that it is made.

3  Authority

This instrument is made under section 35 of the Greenhouse and Energy Minimum Standards Act 2012.

4  Definitions

In this instrument:

commencement day means the day on which this instrument comes into force.

refrigerated cabinets determination means the Greenhouse and Energy Minimum Standards (Refrigerated Cabinets) Determination 2019.

Part 2—Revocation

5  Revocation

(1)  This instrument revokes the refrigerated cabinets determination.

(2)  The refrigerated cabinets determination ceases to be in force on the commencement day.

(3)  If the refrigerated cabinets determination is not yet in force on the commencement day, subsection (2) has the effect that the refrigerated cabinets determination never comes into force.

Note:          The form of this section reflects the requirements of section 35 of the Act, which deal with how a GEMS determination may be revoked without being replaced. Subsection 35(4) of the Act provides that, when a GEMS determination is revoked without being replaced, the revoked determination ceases to be in force at the time specified in the instrument of revocation.
