Schedule 1—Exemption and condition of exemption  2

1  Name

This instrument is the Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 2) 2021.

2  Commencement

This instrument commences the day after it is registered.

3  Authority

This instrument is made under subsection 37(1) of the Greenhouse and Energy Minimum Standards Act 2012.

4  Definitions

In this instrument:

Act means the Greenhouse and Energy Minimum Standards Act 2012.

Determination means the Greenhouse and Energy Minimum Standards (Computers) Determination 2013.

exempt model: see section 5.

5  Exemption

The models specified in clause 1 of the Schedule (the exempt models) are exempt from the requirements of the Determination as described at clause 2 of the Schedule with respect to the supplies of the exempt models specified at clause 3 of the Schedule.

6  Conditions of exemption  

The conditions at clause 4 of the Schedule are specified for the purposes of subsection 37(2) of the Act.

2  Requirements from which the models are exempt

Requirements of the Determination as follows:

GEMS level requirements The identified model is exempted from the GEMS level requirement in relation to the standby (off) power modes, which are set out in section 6(1)(b) of the Determination and in subclause 4.5.3 of AS/NZS 5813.2:2012

3  Supplies to which the exemption applies

This exemption applies in relation to any supplies of computer servers with the specifications set out in clause 1 of this Schedule.
