Schedule 1—Exemption  2

1  Name

This instrument is the Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 2) 2019.

2  Commencement

This instrument commences the day after it is registered.

3  Authority

This instrument is made under subsection 37(1) of the Greenhouse and Energy Minimum Standards Act 2012.

4  Definitions

In this instrument:

Act means the Greenhouse and Energy Minimum Standards Act 2012.

Determination means the Greenhouse and Energy Minimum Standards (Three Phase Cage Induction Motors) Determination 2019.

exempt model: see section 5.

5  Exemption

The models specified in clause 1 of the Schedule (the exempt models) are exempt from the requirements of the Determination as described at clause 2 of the Schedule with respect to the supplies of the exempt models specified at clause 3 of the Schedule.

6  Conditions of exemption  

The condition at clause 4 of the Schedule is specified for the purposes of subsection 37(2) of the Act.

2  Requirements from which model is exempt

Requirements of the Determination as follows:

GEMS level requirements The models are exempted from the GEMS level requirements contained in section 14 of the Determination

3  Supplies to which the exemption applies

This exemption only applies in relation to the supply of motors with the specifications set out in clause 1 above.

4  Specification of condition of exemption

This exemption is subject to the condition that the supply of the motors is restricted to the number of motors currently held in stock as set out in clause 1 above.
