Schedule 1—Exemption and condition of exemption  2

1  Name

This instrument is the Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 1) 2020.

2  Commencement

This instrument commences the day after it is registered.

3  Authority

This instrument is made under subsection 37(1) of the Greenhouse and Energy Minimum Standards Act 2012.

4  Definitions

In this instrument:

Act means the Greenhouse and Energy Minimum Standards Act 2012.

Determination means the Greenhouse and Energy Minimum Standards (Air Conditioners up to 65kW) Determination 2019.

exemption period means the period that this instrument remains in force (see section 7 for the repeal of this instrument).

exempt model: see section 5.

5  Exemption

The models specified in clause 1 of the Schedule (the exempt models) are exempt from the requirements of the Determination as described at clause 2 of the Schedule with respect to the supplies of the exempt models specified at clause 3 of the Schedule.

6  Conditions of exemption  

The conditions at clause 4 of the Schedule are specified for the purposes of subsection 37(2) of the Act.

7  Repeal

This instrument is repealed on the day after the end of the period of 12 months beginning on the day this instrument is registered.

2  Requirements from which the models are exempt

Requirements of the Determination as follows:

GEMS level requirements

The models are exempted from the GEMS level requirements contained in Part 2 and Schedule 1 of the Determination

3  Supplies to which the exemption applies

This exemption only applies in relation to the supply of air conditioners with the specifications set out in clause 1 of this Schedule by Kirby HVAC&R Pty Ltd.

4  Specification of conditions of exemption

This exemption is subject to the following conditions:

(1)   The supply of the air conditioners is restricted to the number of units identified in clause 1 of this Schedule.

(2)   Kirby HVAC&R Pty Ltd must:

(a)notify the GEMS Regulator when delivery of the air conditioners identified in clause 1 is received;

(b)report sales of the units to the GEMS Regulator every 3 months from the date of delivery; and

(c)report the amount of stock remaining at the end of the exemption period (if any) to the GEMS Regulator.
